R-2002-066 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO AMEND THE STATE OF FLORIDA'S STATE HOUSING INITIATIVES PARTNERSHIP (SHIP) PROGRAM BUDGET OF ESTIMATED REVENUES AND EXPENDITURES BY ACCEPTING AN ADDITIONAL ALLOCATION OF EXCESS FUNDS IN THE AMOUNT OF $18,596.00 COLLECTED IN FY 2000-2001 TO BE UTILIZED ACCORDING TO THE CITY OF TAMARAC'S LOCAL HOUSING ASSISTANCE PLAN (LHAP) AND HOUSING DELIVERY GOALS CHART DURING FISCAL YEAR 2001-2002; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROPRIATE SAID FUNDS INCLUDING ANY AND ALL SUBSEQUENT BUDGETARY TRANSFERS (CASE NO.4-MI-02); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the State of Florida's Housing Finance Corporation, the administrators of the State Housing Initiatives Partnership (SHIP) Program, has recently notified the City of Tamarac of an allocation of excess funds collected during Fiscal Year 2000-2001 in the amount of $18,596.00 to be utilized in the State Fiscal Year 2001-2002 (attached hereto as Exhibit "A"); and WHEREAS, allocations received for the SHIP Program must be utilized according to the City of Tamarac's adopted Local Housing Assistance Plan (LHAP) and Housing Delivery Goals Chart; and WHEREAS, according to this Plan, ten (10%) percent of the budget is to be set February 12, 2002 - Temp Reso #9685 2 aside for administration and the remainder is to be used for eligible program activities; and WHEREAS, budgetary adjustments over $10,000.00 per event must be approved by the City Commission for each budgetary adjustment; and WHEREAS, the Director of Community Development recommends acceptance of the additional allocation of excess funds and approval for limited administrative authority for budgetary amendments to the City's SHIP annual grant allocation; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to amend the State of Florida's State Housing Initiatives Partnership (SHIP) Program budget of estimated revenues and expenditures by accepting an additional allocation of excess funds in the amount of $18,596.00 collected in FY 2000- 2001 to be utilized according to the City of Tamarac's Local Housing Assistance Plan (LHAP) and Housing Delivery Goals Chart during Fiscal Year 2001-2002; and authorize the appropriate City Officials to appropriate said funds including any and all subsequent budgetary transfers. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. February 12, 2002 - Temp Reso #9685 3 SECTION 2: That the City Commission authorizes the appropriate City Officials to accept the additional allocation of excess funds in the amount of $18,596.00 for the City of Tamarac's State Housing Initiatives Partnership (SHIP) Program for the State of Florida's Fiscal Year 2001-2002 and to amend the budget to reflect the additional amount to be used according to the City of Tamarac's Local Housing Assistance Plan (LHAP) and Housing Delivery Goals Chart. SECTION 3: That the appropriate City Officials are hereby authorized to amend the SHIP Fund Budget in the amount of $18,596.00 and appropriate said funds, including any and all subsequent budgetary transfer, to be in accordance with proper accounting standards. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 0Ff'TInN R passage and adoption. These funds are to be used for your Local Housing Assistance Program established pursuant to Section 420.9075, Florida Statutes. These funds are to be deposited in your Local Affordable Housing Assistance Trust Fund and are to be used only for programs approved by the Florida Housing Finance Corporation under your Local Housing Assistance Plan.
