R-2002-76 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING THE RESULTS OF THE MARCH 12, 2002 GENERAL ELECTION FOR CITY COMMISSION DISTRICTS 1, 2 and 3; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a General Election was held on March 12, 2002, wherein the electorate of the City of Tamarac elected one candidate for the Office of Commission Representative from District 1 and one candidate for the Office of Commission Representative from District 2; and WHEREAS, the candidate for the Office of Commission Representative from District 3 ran unopposed; and WHEREAS, the Broward County Canvassing Board has canvassed the results of the machine voting and absentee ballots and has certified such results to the City Clerk of the City of Tamarac; and WHEREAS, the City Clerk has reviewed the certification from the Broward County Canvassing Board and has presented their findings to the City Commission for a formal Certification and Declaration of the results; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to declare the results of the March 12, 2002 General Election for City Commission Districts 1, 2 and 3. Temp. Reso. #9723 March 13, 2002 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the following are the certified results of the votes received by candidates seeking the Office of Commission Representative from District 1 at the General Election held March 12, 2002: Edward C. Portner: 542 Donald Rosenthal: 458 Edward C. Portner having received the highest number of votes cast is, therefore, declared to have been elected as Commission Representative from District 1 of the City of Tamarac for a term of three (3) years. SECTION 3: That the following are the certified results of the votes received by candidates seeking the Office of Commission Representative from District 2 at the General Election held March 12, 2002: Lorna Bryan: 53 Miya Burt -Stewart: 184 Pete "The Fireman" lerardi: 283 Gertrude Mishkin: 455 Stewart "Stew" Webster: 295 Temp. Reso. #9723 March 13, 2002 3 Gertrude Mishkin having received the highest number of votes cast is, therefore, declared to have been elected as Commission Representative from District 2 of the City of Tamarac for one (1) year to complete an unexpired term. SECTION 4: Marc L. Sultanof, having run unopposed for the Office of Commission Representative from District 3 has been duly elected to that position for a term of three (3) years. SECTION 5: Edward C. Portner, Gertrude Mishkin, and Marc L. Sultanof shall take office in accordance with the provisions of Section 2-27 of the Tamarac Code. SECTION 6: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 7: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Temp. Reso. #9723 March 13, 2002 4 SECTION 8: This Resolution shall become effective immediately upon its passage and adoption.
