R-2002-78 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING THE RESULTS OF THE REFERENDUM ELECTION VOTING AT THE MARCH 12, 2002 ELECTION ON AMENDMENTS TO THE CITY CHARTER: ORDINANCE NO. 0-2001- 15 (SECTIONS 5.04 AND 5.05) ADMINISTRATION OF OATHS BY THE CITY MANAGER OR HIS DESIGNEE, PROVIDING FOR RECORDKEEPING BY THE CITY CLERK; ORDINANCE NO. 0-2002-002, (SECTION 12.08) REVISING THE TIME LIMIT FOR PROVIDING WRITTEN NOTICE OF DAMAGE OR LOSS REQUIRED BEFORE A CLAIM OR CAUSE OF ACTION MAY BE BROUGHT AGAINST THE CITY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Referendum Election was held on March 12, 2002, wherein the electorate was asked to vote on amendments to the Charter of the City of Tamarac; and WHEREAS, the Broward County Canvassing Board has canvassed the results of the machine voting and absentee ballots and has certified such results to the City Clerk of the City of Tamarac; and WHEREAS, the City Clerk has reviewed the certification from the Broward County Canvassing Board and has presented their findings to the City Commission for a formal Certification and Declaration of the results; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to declare the results of the Referendum Election voting at the March 12, 2002 election on amendments to the City Charter: Ordinance No. 0-2001-15, (Sections 5.04 and 5.05), Ordinance No. 0-2002- Temp. Reso. #9729 March 13, 2002 2 002, (Section 12.08). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the following is hereby certified and declared as the official results of the public vote at the Referendum Election of March 12, 2002, for the proposed Charter Amendments: ORDINANCE NO. 0-2001-15: Amendment to Sections 5.04 and 5.05 of the City Charter, providing for the administration of oaths by the City Manager or his designee; providing for recordkeeping by the City Clerk. Yes: 2,662 No: 411 ORDINANCE NO. 0-2002-002: Amendment to Section 12.08 of the City Charter, revising the time limit for providing the written notice of damage or loss required before a claim or cause of action may be brought against the City. Yes: 2,512 No: 523 SECTION 2: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
