R-2002-135 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A VACATION OF EASEMENT OF AN EXISTING TWELVE (12') FOOT WIDE UTILITY EASEMENT LOCATED ALONG THE PROPERTY LINE BETWEEN LOTS 7 AND 8 OF THE "TAMARAC BUSINESS CENTER SECTION 2" PLAT; SPECIFICALLY A PORTION OF LOTS 6, 7 AND 8 OF THE "TAMARAC BUSINESS CENTER SECTION 2" PLAT", ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 61, PAGE 50 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (CASE NO. 2-P-02); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Easement described in Exhibit "A" was dedicated to the public on April 1, 1966 at the time of the initial recordation of the Plat; and WHEREAS, the property owner, Progressive Development Group, Inc., has determined that the twelve foot (12') wide utility easement located along the property line between Lots 7 and 8 of the "Tamarac Business Center Section 2" Plat (as depicted in Exhibit "A") is needed in order to accommodate the redevelopment of the existing BP Amoco Facility #835 located at 4990 North State Road 7; and WHEREAS, the City Engineer and franchised Utility Companies have been contacted and all have stated no objection to the vacation of the twelve foot (12') wide utility easement to facilitate any future improvements; and WHEREAS, the Director of Community Development recommends approval of this vacation of easement; and May 2, 2002 - Temp Reso #9777 2 Revision No. 1 — May 14, 2002 WHEREAS, the Planning Board recommended approval on May 1, 2002; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the vacation of easement of an existing twelve foot (12') wide utility easement located along the property line between Lots 7 and 8 of the "Tamarac Business Center Section 2" Plat; specifically a portion of Lots 6, 7 and 8 of the "Tamarac Business Center Section 2" Plat, according to the Plat thereof as recorded in Plat Book 61, Page 50 of the Public Records of Broward County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the vacation of easement of an existing twelve (12') foot wide utility easement (attached hereto as Exhibit "A") located along the property line between Lots 7 and 8 of the "Tamarac Business Center Section 2" Plat; specifically a portion of Lots 6, 7 and 8, of the "Tamarac Business Center Section 2" Plat, according to the Plat thereof as recorded in Plat Book 61, Page 50 of the Public Records of Broward County, Florida; is hereby granted. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. May 2, 2002 - Temp Reso #9777 3 Revision No. 1 -- May 14, 2002 SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
