RESOLUTION NO. R-2002-141
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA, TO
APPROVE A DELEGATION REQUEST TO
AMEND THE NOTE ON THE "WESTPOINT
SECTION 7 PLAT" TO ACCURATELY
REFLECT THE APPROVED SQUARE
FOOTAGE AND USES ON CERTAIN TRACTS
AS SPECIFIED IN THE WESTPOINT
DEVELOPMENT OF REGIONAL IMPACT
(DRI), SPECIFICALLY TRACTS "A", "B", "C"
AND "D" OF THE "WESTPOINT SECTION 7
PLAT", ACCORDING TO THE PLAT THEREOF
AS RECORDED IN PLAT BOOK 162, PAGE 23
OF THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA; LOCATED AT THE
NORTHWEST CORNER OF COMMERCIAL
BOULEVARD AND NOB HILL ROAD (CASE
NO. 3-P-02); PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission has examined the application and staff
recommendation dated May 16, 2002; and
WHEREAS, the City Commission has determined that the application is in compliance
with all elements of the Comprehensive Plan for the development that is the subject of the
application; and
WHEREAS, the property owner desires to amend the note on the plat to reflect the
assigned square footage and uses on certain tracts as specified in the Westpoint Development
of Regional Impact (DRI), specifically Tracts "A", "B", "C" and "D" of the "Westpoint Section 7
Plat", according to the Plat thereof as recorded in Plat Book 162, Page 23 of the Public Records
of Broward County, Florida (attached hereto as Exhibit "A" and Exhibit "B"); and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the Planning Board recommended approval on May 15, 2002; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the
best interests of the citizens and residents of the City of Tamarac to approve this Delegation
Request.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby approves the Delegation
Request to reflect the assigned square footage and uses on certain tracts as specified in the
Westpoint Development of Regional Impact (DRI), specifically Tracts "A", "B", "C" and "D" of
the "Westpoint Section 7 Plat", according to the Plat thereof as recorded in Plat Book.162,
Page 23 of the Public Records of Broward County, Florida.

SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by any courtof competent jurisdiction to be unconstitutional or invalid, in part or application,
it shall not affect the validity of the remaining portions or applications of this Resolution.

EXISTING NOTE
This plat is restricted to 768,398 square feet of office use and 768,398
square feet of industrial use on Tracts A, B and C; Tract D is restricted
to a 300 room hotel and 400,000 square feet of commercial use.
Commercial/retail uses are not permitted within Tracts A, B and C
without the approval of the Board of County Commissioners who shall
review and address these uses for increased impacts.

This plat is restricted to 311,000 square feet of office use and 649,000
square feet of industrial use on Tracts A and B. A 300'room hotel and
103,200 square feet of auto dealership with 223,263 square feet of auto
storage are also permitted on Tract B. Office use of 100,000 square feet
is permitted on Tract C. Tract D is restricted to 200.000 square feet of
commercial use. Commercial/retail uses are not permitted on Tracts A
and B without the approval of the Board of County Commissioners who
shall review and address these uses for increased impacts.
