R-2002-152 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE PARTICIPATION OF THE CITY OF TAMARAC IN THE BROWARD COUNTY RAIN SHUTOFF DEVICE PILOT PROGRAM; AGREEING TO ISSUE PERMITS AND WAIVE PERMIT AND INSPECTION FEES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the excessive use of water for landscape irrigation accounts for the greatest waste of water in South Florida's counties and cities; and WHEREAS, the installation of rain shutoff devices provides an opportunity to conserve water by reducing the excessive use of water for landscape irrigation; and WHEREAS, Broward County will receive a $50,000.00 grant from the South Florida Water Management District to implement a rain shutoff device pilot program in Broward County by contracting with licensed contractors to install the devices; and WHEREAS, the City of Tamarac shall participate in the Broward County pilot rain shutoff device program; and WHEREAS, the City of Tamarac shall waive the permit and inspection fee for rain shutoff device for qualified program participants within the City; and 1 Temp. Reso. #9780 May 7, 2002 2 Revised 2, May 30, 2002 WHEREAS, the City of Tamarac shall determine which participants are selected for the program from participants representing single-family homes, multi family homes, and condominiums; and WHEREAS, the City of Tamarac shall pre -qualify participants by verifying that the water is supplied by the City (not well water or lake water) and that a low voltage timer is already present and operational; and WHEREAS, the City of Tamarac shall require that as a prerequisite for participation in the Rain Shutoff Device Pilot Program, each participant must attend a workshop taught by staff from the Broward County Department of Planning and Environmental Protection (DPEP) to qualify for the Program; and WHEREAS, the City of Tamarac shall issue the appropriate permits and provide Broward County with notice that the rain shutoff device has been installed in accordance with the Florida Building Code; and WHEREAS, the Director of Utilities recommends that the City of Tamarac participate in the rain shutoff device pilot program and waive permit and inspection fees for participants; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to participate in the rain shutoff device program and waive permit and inspection fees for participants. 1 1 1 1 Temp. Reso. #9780 May 7, 2002 3 Revised 2, May 30, 2002 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: The City of Tamarac shall participate in the Broward County pilot rain shutoff device program by signing a partnership form (attached hereto as Exhibit ►21 SECTION 3: The City of Tamarac agrees to waive the permit and inspection fee for installation of the Rain Shutoff Devices. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Either ❑ Waive permitting fees for residents who participate by issuing a Resolution like the example enclosed OR ❑ Sign an Interlocal agreement with Broward County to do the permitting, waive the permitting fee and conduct follow-up inspections. The Interlocal agreement is enclosed. (you must check one or the other and provide either the Resolution or the Interlocal Agreement).
