R-2002-196 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE CITY MANAGER TO SEND A PROPOSED MILLAGE RATE OF 5.9999 MILLS TO THE PROPERTY APPRAISER FOR FISCAL YEAR 2003 AND SETTING SEPTEMBER 11TH, 2002 AT 6:30 P.M. AT THE TAMARAC COMMISSION CHAMBERS, 7525 N.W. 88TH AVENUE, TAMARAC, FLORIDA AS THE DATE, TIME AND PLACE FOR THE FIRST PUBLIC BUDGET HEARING; SETTING SEPTEMBER 18TH, 2002 AT 6:30 P.M. AT THE TAMARAC COMMISSION CHAMBERS, 7525 N.W. 88TH AVENUE, TAMARAC, FLORIDAAS THE DATE, TIME, AND PLACE FOR THE SECOND PUBLIC BUDGET HEARING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statute 200.065 (TRIM — Truth in Millage) requires all municipalities, within 35 days of receipt of the city's certification of taxable value (on or around July 1), to advise the Property Appraiser of an estimated millage rate to be included in the TRIM notice sent to each taxpayer; and WHEREAS, an estimated and tentative millage rate should be proposed which would allow the City Commission latitude in meeting fiscal year 2003 budgetary requirements; and Temp Reso #9814 Page 2 June 3, 2002 WHEREAS, Florida Statute 200.065 requires that a hearing date, other than that scheduled by the Broward County Commission and the Broward County School Board, be set by each municipality to be included in the TRIM Notice sent to each taxpayer; and WHEREAS, the Assistant City Manager/Interim Director of Finance and Budget Officer recommend that the estimated millage rate be set at 5.9999 mills for Fiscal Year 2003, and that the public budget hearings be set at 6:30 p.m. on September 11 and September 18, 2002 in the City Commission Chambers, 7525 NW 88th Avenue, Tamarac, Florida 33321; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to allow the City Manager to send an estimated and tentative millage rate of 5.9999 mills to the Property Appraiser and to set a date, time, and place for the first and second public hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Manager is authorized to send notification to the Property Appraiser of the estimated millage rate of 5.9999 mills for fiscal year 2003 along with the date, time and place of the first Public Budget hearing being on September 11, 2002 at 6:30 P.M. at the City of Tamarac Commission Chambers, 7525 N.W. 88th Avenue, Tamarac, Florida 33321. 1 �l 1 1 Temp Reso #9814 Page 3 June 3, 2002 SECTION 3: The City Commission chooses September 18, 2002 at 6:30 P.M. at the City of Tamarac Commission Chambers, 7525 N.W. 88th Avenue, Tamarac, Florida 33321, as the date, time, and place for the second public budget hearing. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part of application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of the Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption.
