R-2002 -226 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO RELEASE A PUBLIC IMPROVEMENT PERFORMANCE BOND IN THE FORM OF AN IRREVOCABLE STANDBY LETTER OF CREDIT #3035851 IN THE AMOUNT OF $22,300.00 FOR THE CLEARING AND GRUBBING OF THE MCNAB ROAD PARK PROPERTY LOCATED AT THE WESTERN END OF MCNAB ROAD, EAST OF THE SAWGRASS EXPRESSWAY; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO WAIVE THE REQUIREMENT FOR THE RECEIPT OF A ONE-YEAR WARRANTY BOND; AUTHORIZING THE CITY CLERK TO RELEASE IRREVOCABLE STANDBY LETTER OF CREDIT #3035851; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, SB Tamarac Commerce Center, LLC and NB Tamarac Commerce Center, LLC, has completed the clearing and grubbing of the McNab Road Park Property, located at the western end of McNab Road, east of the Sawgrass Expressway (attached hereto in map form as "Exhibit 1 "); and WHEREAS, the terms of section 10-156 of the City Code required SB Tamarac Commerce Center, LLC and NB Tamarac Commerce Center, LLC, to provide a Public Improvement Performance Bond to the City of Tamarac (a copy of which is attached hereto as "Exhibit 2") for the McNab Road Park property clearing and grubbing; and WHEREAS, Section 10-156 requires that a one-year Warranty Bond be issued upon release of the Public Performance Bond; and WHEREAS, the one-year Warranty Bond for this Project would be in the amount of $5,575.00; and Temp. Reso. #9875 - August 19, 2002 Page 2 Rev. #1 - 8/20/02 WHEREAS, SB Tamarac Commerce Center, LLC and NB Tamarac Commerce Center, LLC, has requested release of the Public Performance Bond in the form of Irrevocable Standby Letter of Credit #3035851 in the amount of $22,300.00; and WHEREAS, the clearing and grubbing of the McNab Road Park property has been inspected and has been approved as being satisfactory by the Parks and Recreation Director and the City Engineer; and WHEREAS, construction will begin on the development of the McNab Road Park property, the Parks and Recreation Department and Engineering Division are requesting the requirement for the receipt of a one-year warranty bond in the amount of $5,575.00 required by City Code Section 10-156 be waived; and WHEREAS, it is the recommendation of the Director of Parks and Recreation and City Engineer that the Public Improvement Performance Bond be released for the McNab Road Park Property clearing and grubbing and that the one-year Warranty Bond requirement be waived; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to release the Public Performance Bond from SB Tamarac Commerce Center, LLC and NB Tamarac Commerce Center, LLC, for the clearing and grubbing of the McNab Road Park property and to waive the requirement for the receipt of a one-year Warranty Bond. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. Reso. #9875 - August 19, 2002 Page 3 Rev. #1 - 8/20/02 SECTION 2: The appropriate City Officials are hereby authorized to release the Public Improvement Performance Bond in the amount of $22,300.00 for the clearing and grubbing of the McNab Road Park property. SECTION 3: The requirements for receipt of a one-year warranty bond for the clearing and grubbing of the McNab Road Park property is hereby waived. SECTION 4: The City Clerk is hereby authorized and directed to release to the Parks and Recreation Department for return to SB Tamarac Commerce Center, LLC and NB Tamarac Commerce Center, LLC, the Public Improvement Bond for the clearing and grubbing of the McNab Road Park property. The bond is in the form of an Irrevocable Standby Letter of Credit #3035851 in the amount of $22,300.00 for the clearing and grubbing of the McNab Road Park property located at the western end of McNab Road, east of the Sawgrass Expressway. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 Temp.
