CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2002-284
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO RELEASE A
WARRANTY BOND IN THE FORM OF LETTER OF
GUARANTEE #LG-1012 FROM NATBANK, NA IN THE
AMOUNT OF $2,156.25 POSTED BY ACTIVE SENIOR
LIVING RESIDENCE, INC. FOR PAVING, SIDEWALK AND
CURB IMPROVEMENTS LOCATED ON THE NORTH SIDE
OF N.W. 57TH STREET BETWEEN N.W. 91ST AVENUE
AND PINE ISLAND ROAD; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, as part of the Active Senior Living Residence project, Active Senior
Living Residence, Inc. has constructed paving, sidewalk and curb improvements in
accordance with the Site Plan approved by the City Commission on March 25, 1998
through resolution number R-1998-88; and
WHEREAS, Active Senior Living Residence, Inc. has filed with the City of
Tamarac a Warranty Bond in the form of Letter of Guarantee #LG-1012, in the amount
of $2,156.25 for paving, sidewalk and curb improvements located on the north side of
N.W. 57th Street between N.W. 91st Avenue and Pine Island Road, a copy of said letter
of guarantee attached hereto as Exhibit "A"; and
WHEREAS, paving, sidewalk and curb improvements for the Active Senior Living
Residence project have been inspected and found acceptable by the Public Works
Engineering Division; and

WHEREAS, pursuant to City Code Section 10-156, this Public Improvement
Warranty Bond in the form of Letter of Guarantee #LG-1012, has remained in place for
the required one (1) year period; and
WHEREAS, it is the recommendation of the Public Works Director and the
Assistant City Engineer that this Public Improvement Warranty Bond be released; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the citizens and residents of the City of Tamarac to release
this Warranty Bond in the form of Letter of Guarantee #LG-1012 in the amount of
$2,156.25, posted by Active Senior Living Residence, Inc. for paving, sidewalk and curb
improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
Section 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution.
Section 2: The appropriate City Officials are hereby authorized to release this
Warranty Bond in the form of Letter of Guarantee #LG-1012, in the amount of $2,156.25
posted by Active Senior Living Residence, Inc. for paving, sidewalk and curb
improvements located on the north side of N.W. 57th Street between N.W. 915t Avenue
and Pine Island Road.
Section 3: That all Resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

Section 4: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section 5: This Resolution shall become effective immediately upon its
passage and adoption.

on presentation of the original draft of this Letter of Guarantee. We shall honor your demand for

I am pleased to advise you that at its meeting of October 9, 2002, the City
Commission approved a resolution authorizing the release of a Warranty Bond in the
form of Letter of Guarantee #LG-1012 from NATBANK, NA, in the amount of $2,156.25
for paving, sidewalk and curb improvements at the Active Senior Living Residence
project located on the north side of NW 57th Street between NW 91 St Avenue and Pine
Island Road. Enclosed is a copy of the approved resolution for your records as well as
the original Warranty Bond.
