CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2002-31()
A RESOLUTION OF THE CITY
COMMISSION OF THE CITY OF TAMARAC,
FLORIDA, TO APPROVE A DELEGATION
REQUEST TO AMEND NOTE NO. 9 ON
TRACT "A" OF THE "COMROCK PLAT" TO
PROVIDE VEHICULAR EGRESS AND
INGRESS FROM ROCK ISLAND ROAD
LOCATED AT THE NORTHEAST CORNER
OF THE SUBJECT PLAT AND DIRECTLY
ABUTTING ROCK ISLAND ROAD;
SPECIFICALLY TRACT "A" OF THE
"COMROCK PLAT", ACCORDING TO THE
PLAT THEREOF AS RECORDED IN PLAT
BOOK 95, PAGE 47 OF THE PUBLIC
RECORDS OF BROWARD COUNTY,
FLORIDA (CASE NO. 5-P-02); PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission has examined the application and staff
recommendation dated October 17, 2002, and
WHEREAS, the City Commission has determined that the application is in
compliance with all elements of the Comprehensive Plan for the development that is the
subject of the application; and
WHEREAS, at the time the plat was recorded, the City of Tamarac and Broward
County did not have the benefit of a conceptual site plan for the property to utilize the
determination of entrance openings; and
WHEREAS, the property owner desires to amend Note No. 9 on Tract "A" of the
°''Comrock Plat" to provide vehicular egress and ingress from Rock Island Road located
at the northeast come, of the subject plat directly abutting Rock Island Road;
specifically Tract "A" of the "Comrock Plat", according to the Plat thereof as recorded in
Temp. Reso. #9933 -- October 17, 2002

Plat Book 95, page 47 of the Public Records of Broward County, Florida (Case No. 5-P-
02); and

WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the Planning Board recommended approval on October 16, 2002;
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be
in the best interest of the citizens and residents of the City of Tamarac to approve this
Delegation Request.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
SECTION 2: That the City Commission hereby approves the Delegation
Request to amend Note No. 9 on Tract "A" of the "Comrock Plat" to provide vehicular
egress and ingress from Rock Island Road located at the northeast corner of the
subject Plat and directly abutting Rock Island Road; specifically Tract "A" of the
"" Cornrock Plat according to the Plat thereof as recorded in Plat Book 95, Page 47 of
the Public Records of Broward County, Florida.
SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portion or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon
adoption.
PASSED, ADOPTED AND APPROVED this 23rd day of October, 2002.
