R-2002- 3 7' A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE AND EXECUTE THE SECOND AMENDMENT TO THE INTERLOCAL AGREEMENT FOR THE REAPPORTIONMENT OF MEMBERSHIP OF THE BROWARD COUNTY METROPOLITAN PLANNING ORGANIZATION (BCMPO) TO REFLECT THE CHANGES IN POPULATION DISTRIBUTION AS SET OUT IN THE 2000 CENSUS, TO INCREASE THE NUMBER OF VOTING MUNICIPALITIES, TO BETTER ADDRESS ISSUES PERTAINING TO RAPID GROWTH, LAND USE, TRANSIT NEEDS, TRAFFIC CONCURRENCY AND ECONOMIC DEVELOPMENT (CASE NO. 17-MI-02); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Broward County Metropolitan Planning Organization (BCMPO) has determined that it is in the best interest of the residents of Broward County that the membership of MPO be reapportioned to reflect the changes in population distribution as set out in the 2000 Census; and WHEREAS, the reapportionment plan increases the number of voting municipalities to improve involvement in transportation issues and activities relating to rapid growth; and WHEREAS, the Broward County Metropolitan Planning Organization (BCMPO) has determined that implementation of the reapportionment plan will improve the effectiveness of the BCMPO in addressing the needs and challenges the County continues to face, Temp Reso #9979 — November 14, 2002 Page 2 including rapid growth, land use, traffic concurrency, transit needs and economic development; and WHEREAS, the reapportionment plan initiated by the MPO is pursuant to Section 339.175(2)(c), Florida Statutes; and I. an] WHEREAS, Broward County is a charter county with over one million population; WHEREAS, the MPO has approved the reapportionment plan by a three -fourths vote of its membership in compliance with Section 339.175(2)(c)1., Florida Statutes; and WHEREAS, the MPO has determined that the reapportionment plan is needed to fulfill specific goals and policies applicable to the metropolitan area in compliance with Section 339.175(2)(c)2., Florida Statutes; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to approve and execute the Second Amendment to the Interlocal Agreement for the reapportionment of membership of the BCMPO to reflect the changes in population distribution as set out in the 2000 Census, to increase the number of voting municipalities, to better address issues pertaining to rapid growth, land use, transit needs, traffic concurrency and economic development. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- n 0 0 Temp Reso #9979 — November 14, 2002 Page 3 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the appropriate City Officials are hereby authorized to approve and execute the Second Amendment to the Interlocal Agreement for the reapportionment of membership of the BCMPO to reflect the changes in population distribution as set out in the 2000 Census, to increase the number of voting municipalities, to better address issues pertaining to rapid growth, land use, transit needs, traffic concurrency and economic development (attached hereto as Exhibit 1 "). SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. �qFr.TICW adoption. Fourteen (14) voting members shall be municipal representatives. For the purpose of determining municipal representation on the MPO, Broward County has been divided into five 5) municii)al.districts. In accordance with the reapportionment plan, the two (2) most populous municipalities in Districts 1 and 2, as designated on Table 1- 2 A shall each appoint one (1) of„its_generally elected officials to be the voting representatives for the districts _ In District 3, the .City of Fort Lauderdale shall designate two 2 votin ,_representatives and the next three -C3Lmoat_ populous municipalities, as_desiqnated_on Table-1., shall each appoint one 1 of its .generally_ elected_ officials to be the voting representative for the district. (c), The voting and non -voting members of any district may revise their voting membership within the district when approved by resolution of all the municipalities within the district. _ The revised voting membership plan shall become incorporated into the I_nterlocal Agreement without further action of the MPO upon forwarding the revised membership r)lan to the MPO and the Governor's Office. {e)(dj In the event that a governmental entity that is a member of the MPO fails to fill an assigned appointment to the MPO within sixty (60) days after notification by the Governor of its duty to appoint a representative, that appointment shall be made by the Governor from the eligible individuals of that governmental entity. 3 2. Section 7.02, Amendment of Agreement is hereby amended as follows: Section 7.02. Amendme.n.t_ofi_A.gre,m ee_nt. Amendments or modifications of this Agreement may only be made by written agreement signed by all parties here to with the same formalities as the original Agreement except as othennrise proyided in Section 4.01(c) above. No amendment may alter the apportionment or jurisdictional boundaries of the MPO without approval by the Governor. 3. Section 7.04, Notices is hereby amended as follows: Section 7.04. Notices. All notices, demands and correspondence required or provided for under this Agreement shall be in writing and delivered in person or dispatched by certified mail, postage prepaid, return receipt requested. Notice required to be given shall be addressed as feifews- set forth within Table 3. A party may unilaterally change its address or addressee by giving notice in writing to the other parties as provided in this section. Thereafter, notices, demands and other pertinent correspondence shall be addressed and transmitted to the new address. 4. Except as amended herein all other terms and conditions of the Interlocal Agreement recorded in OR Book 30444, Page 1278 shall remain in full force and effect- 5- This Second Amendment shall become effective upon its filing in the public records of Broward County_ (Pursuant to Section 4.02 of the Charter of Broward County all duties prescribed by the Constitution and the Laws of Florida for the Office of Clerk of the Circuit Court relating to the duties as custodian of public documents have been transferred to the Department of Finance and Administrative Services.) 6. Broward County hereby agrees to record this Second Amendment in the public records of Broward County. E!
