R2002-341 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING ONE REGULAR MEMBER TO THE BOARD OF ADJUSTMENT TO COMPLETE AN UNEXPIRED THREE-YEAR TERM ENDING JULY 16, 2003; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on June 27, 2001, the City Commission approved Resolution No. R2001-168, wherein Robert L. Wolfe, Jr. was appointed to the Board of Adjustment to complete an unexpired term ending July 16, 2003 (attached as Exhibit "A"); and WHEREAS, on October 28, 2002, Robert L. Wolfe, Jr. tendered his resignation from the Board of Adjustment (attached as Exhibit "B"); and WHEREAS, the City Commission is desirous of appointing one regular member to the Board of Adjustment to complete an unexpired three-year term ending July 16, 2003; and WHEREAS, in accordance with Sections 24-36 and 24-37 of the Tamarac Code (attached as Exhibit "C") members of the Board of Adjustment shall be appointed by the City Commission and serve for overlapping terms of three years or thereafter until their successors are appointed; and WHEREAS, the Community Development Director and City Manager recommend approval; and Temp. Reso. #9967 Page 2 October 31, 2002 WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interest of the citizens and residents of the City of Tamarac to appoint one regular member to the Board of Adjustment to complete an unexpired three- year term ending July 16, 2003. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That pursuant to Sections 24-36 and 24-37 of the Tamarac Code, the following person is hereby appointed as a member of the Board of Adjustment to complete an unexpired three-year term ending July 16, 2003, or until such time as reappointments are made: Richard Robbins SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1-1 Temp. R2001-168 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING TWO REGULAR MEMBERS TO THE BOARD OF ADJUSTMENT TO SERVE THREE YEAR TERMS EXPIRING JULY 16, 2004, APPOINTING ONE REGULAR MEMBER TO FILL AN UNEXPIRED TERM UNTIL JULY 16, 2003; PROVIDING FOR ELECTION OF A CHAIR AND VICE CHAIR; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission is desirous of appointing two (2) regular members to the Board of Adjustment to serve three-year terms expiring July 16, 2004, and one (1) regular member to fill an unexpired term until July 16, 2003; MTJ WHEREAS, in accordance with Sections 24-36 and 24-37 of the Tamarac Code (attached hereto as Exhibit A) members of the Board of Adjustment shall be appointed by the City Commission and serve for overlapping terms of three (3) years or thereafter until their successors are appointed; and WHEREAS, in accordance with Section 24-37(c) of the Tamarac Code any vacancy occurring during the unexpired term of office of any member shall be filled by the City Commission for the remainder of the term. Wolfe, Jr. Deputy Director, Community Services Cc: Marion Swenson, City Clerk r. § 24.6 TAMARAC CODE classifications shall be presumed to be valid clas- sifications of the lands annexed and shall not be subject to change, except upon evidence being pre- sented of a change of circumstances or as a part of the adoption or implementation of a comprehen- sive plan for the city; provided, that the owners of property annexed may, by instrument in writing, waive the presumption of validity and apply for zoning classification of such annexed property de novo. (Code 1975, § 28-6) Sec:. 24.7. Enforcement officer. The city manager, or any official or employee designated in writing by the city manager, is hereby designated and authorized to enforce this chapter. (Code 1975, § 28-7) Sec. 24.8. Penalty. Any person who violates or fails to comply with any of the provisions of this chapter shall, upon conviction, be fined by a fine not exceeding five hundred dollars ($500.00) or imprisonment not ex- ceeding sixty (60) days or by both such fine and imprisonment in the discretion of the judge of the municipal court. BOARD OF ADJUSTMENT* *Cross reference —Appointed boards, commissions, com- mittees to elect officers, provisions regarding absenteeism of members, § 2.81; boards, committees, commissions, § 2-66 et seq.; conflicts of interest, § 2.261 et seq.; board of adjustment shall have the authority to consider an act upon applications for a variance from the provisions of the flood prevention and protection chapter, § 8.10. Supp. No. 2 Sec. 24-36. Creation; members. There is hereby created a board of adjustment consisting of five; (5) members. Members of the - board of adjustment shall be appointed by the city council. In addition, the city council may appoint not more than two (2) alternate members, desig- nating them as such. Such alternate members may act in the temporary absence or disability of any regular member, or may act when a regular member is otherwise disqualified in a particular case that may be presented to the board. No member or alternate member of the board of ad- justment shall be a paid or elected official or em- ployee of the city. (Code 1975,.§ 28.9) Sec. 24.37. Terms; removal of members; va• cancies. (a) Members of the board of adjustment shall serve for overlapping terms of three (3) years or thereafter until their successors are appointed; pro- vided, that subsequent to July 10,. 1974, the first appointments to the board of adjustment consti- tuted under this article shall consist of two (2) terms three (3) years in duration, two (2) terms four (4) years in duration, and one (1) term five (5) years in duration. Not more than a minority of the terms of such members shall expire in any one (1) year. (b) Any member of the board of adjustment may be removed from office for cause by the city council upon written charges and after public hearing. (c) Any vacancy occurring during the unexpired term of office of any member shall be filled by the city council for the remainder of the term,. Such vacancy shall be filled within thirty (30) days after the vacancy occurs. (Code 1975, § 28-10) Sec. 24.38. Officers; rules of procedure; records; meetings. The board of adjustment shall elect a chairman and a vice-chairman from among its members and shall appoint a secretary, who may be an officer or employee of the city or of the planning commis- sion.
