R-2002-. a5_�7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE COMPLETION AND SUBSEQUENT SUBMISSION OF THE PROGRAM DESCRIPTION APPLICATION TO BROWARD COUNTY UPON ITS AVAILABILITY FOR THE USE OF FUNDS THROUGH THE HOME INVESTMENT PARTNERSHIPS PROGRAM CONSORTIUM FOR THE CITY OF TAMARAC'S MINOR HOME REPAIR PROGRAM WITH AN OPTION TO SHIFT FUNDING INTO THE FIRST-TIME HOMEBUYERS' PURCHASE ASSISTANCE SHOULD ALL MINOR HOME REPAIR APPLICATIONS BE ADDRESSED AND REMAINING FUNDS ARE AVAILABLE FOR THE FIRST-TIME HOMEBUYER PROGRAM; APPROVING THE CITY'S DESIGNATION OF FEDERALLY REQUIRED SET -ASIDE OF FIFTEEN (15%) PERCENT FOR THE COMMUNITY HOUSING DEVELOPMENT ORGANIZATION (CHDO) TO BE POOLED WITH BROWARD COUNTY'S FOR THE FIRST YEAR WITH AN OPTION TO RENEW FOR THE SECOND AND THIRD YEAR OF THE PROGRAM (CASE NO. 20-MI-02); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the National Affordable Housing Act of 1990 authorized the U.S. Department of Housing and Urban Development ("HUD") to provide financial assistance to local governments to undertake or to assist in undertaking housing assistance activities in accordance with the HOME Investment Partnerships Program ("HOME Program"); and Temp Reso #9993 — November 25, 2002 Revision No. 1 — November 27, 2002 Revision No. 2 — December 4, 2002 Revision No. 3 — December 5, 2002 Page 2 WHEREAS, under Resolution No. 2002-159 (attached hereto as Exhibit I"), the City of Tamarac and Broward County signed an agreement to participate as a member of the Broward County Consortium for a three-year period beginning in 2003 in exchange for approximately $115,200.00 each year in HOME funds for the operation of housing programs; and WHEREAS, HOME funds may be used for eligible housing activities that address the needs of low and moderate income families; and WHEREAS, the City of Tamarac currently operates a successful Minor Home Repair Program and a First -Time Homebuyer Program; and WHEREAS, there is currentlya waiting listforthe MinorHome RepairProgram; and WHEREAS, HOME funding will enable the City to address approximately six (6) more homes; and WHEREAS, a program description and application of the City's proposed program must be completed and submitted to Broward County; and WHEREAS, it is the recommendation of the Director of Community and the City Manager that this program description application be completed to address the Minor Home Repair Program with the ability to shift funding to the First -Time Homebuyer Program should all Minor Home Repair applications be addressed and funding is needed for the First -Time Homebuyer Program; and WHEREAS, a minimum of fifteen (15%) percent of each municipality's allocation must be set aside each year for a qualified Community Housing Development Organization Temp Reso #9993 — November 25, 2002 Revision No. 1 — November 27, 2002 Revision No. 2 — December 4, 2002 Revision No. 3 — December 5, 2002 Page 3 (CHDO); and WHEREAS, Broward County is preparing an RFQ for a County -wide CHDO; and WHEREAS, Broward County has provided the option for each municipality to meet its Federal CHDO requirement by pooling its CHDO monies with the County's program; UITS I WHEREAS, there is currently no Community Housing Development Organization (CHDO) operating within the City of Tamarac; and WHEREAS, the City of Tamarac's set -aside is approximately $17,280.00, an insufficient amount to operate a full program individually; and WHEREAS, it is the recommendation of the Director of Community Development and the City Managertojoin Broward County's CHDO pool forthe first yearwith the option to participate the following two (2) years of the program; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the completion and subsequent submission of the program description application to Broward County upon its availability for the use of funds through the HOME Investment Partnerships Program Consortium for the City of Tamarac's Minor Home Repair Program with an option to shift funding into the First -Time Homebuyers purchase assistance should all Minor Home Repair applications be addressed and remaining funds are available for the First - Time Homebuyer Program; approving the City's designation of Federally required set -aside of fifteen (15%) percent for the Community Housing Development Organization (CHDO) to Temp Reso #9993 — November 25, 2002 Revision No. 1 — November 27, 2002 Revision No, 2 — December 4, 2002 Revision No. 3 — December 5, 2002 Page 4 be pooled with Broward County's for the first year with an option to renew for the second and third year of the program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution, SECTION 2: That the appropriate City Officials are authorized to obtain from Broward County upon availability, complete and submit the program description application to address minor home repair with the ability to shift funds to first-time homebuyer purchase assistance for submittal to Broward County for the HOME Investment Partnerships Program Consortium, SECTION 3: The City of Tamarac agrees to designate its fifteen (15%) percent set -aside for CH DOs to be pooled with Broward County in order to meet its Federal requirement. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. 1_1 I Fil Temp Reso #9993 — November 25, 2002 Revision No. 1 — November 27, 2002 Revision No. 2 — December 4, 2002 Revision No. 3 — December 5, 2002 Page 5 SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its adoption. PASSED, ADOPTED AND APPROVED this 11 th day of December, 2002.
