CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2001-162
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE CHANGE
ORDER NO. 1 WITH WEEKLEY ASPHALT PAVING, INC. IN
AN AMOUNT NOT TO EXCEED $22,400; AUTHORIZING
THE EXPENDITURE OF $22,400 FOR CHANGE ORDER NO.
1 FROM PROJECT CONTINGENCY; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 13, 1999 the City entered into an agreement with Weekley
Asphalt Paving, Inc. to resurface approximately 30 miles of streets under Phase I I -A of the
Seven Year Comprehensive Street Improvement Program as authorized by Resolution No.
R99-277; and
WHEREAS, on March 14, 2001, the City Commission of the City of Tamarac
amended the aforesaid agreement and authorized Phase III of the Comprehensive Street
Improvement Program by approving Resolution No. R-2001-51; and
WHEREAS, the Phase III Work Plan provided for the resurfacing of 33.73 miles of
City streets; and
WHEREAS, Public Works staff completed the stormwater improvements on
Umbrella Tree Lane ahead of schedule; and
WHEREAS, Umbrella Tree Lane is now ready for milling and resurfacing and could
be added to Phase III of the Comprehensive Street Improvement Program; and
WHEREAS, adding this roadway segment to Phase III would cost $22,400, and five
(5) additional days to the project schedule; and

WHEREAS, in Resolution No. R-2001-51, the City Commission authorized a total I
appropriation of $1,425,102.31 based upon an estimated construction expenditure of
$1,239,219.40 and a project contingency of $185,882.91 for Phase 111; and
WHEREAS, based on projected cost so far, it is estimated that funds would be
available for Umbrella Tree Lane in the authorized construction expenditure. Otherwise,
funding will be allocated from the project contingency; and
WHEREAS, it is the recommendation of the Public Works Director that Change
Order No. 1 with Weekley Asphalt Paving, Inc. be executed for milling and resurfacing of
Umbrella Tree Lane; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to execute Change
Order No. 1 with Weekley Asphalt Paving, Inc. for milling and resurfacing of Umbrella Tree
Lane.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing WHEREAS clauses are HEREBY ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: The appropriate City Officials are HEREBY authorized to
execute Change Order No. 1 with Weekly Asphalt Paving, Inc. for the resurfacing of
Umbrella Tree Lane in an amount not to exceed $22,400, attached hereto as Exhibit 1.
SECTION 3: The expenditure of $22,400 for Change Order No. 1 is HEREBY

become necessary to
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are
HEREBY repealed to the extent of such conflict.
SECTION 5: If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Resolution that can be given effect without the invalid provision or
application, and to this end the provisions of this Resolution are declared to be severable.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

CONTRACT, THE CONTRACTOR AND THE CITY DO BOTH HEREBY AGREE THAT THE
CONTRACTOR SHALL MAKE THE FOLLOWING CHANGES, ADDITIONS OR DELETIONS TO THE
WORK SPECIFIED IN THE PLANS AND SPECIFICATIONS. UNLESS STATED OTHERWISE, ALL
WORK SHALL BE PERFORMED ACORDING TO THE TERMS AND CONDITIONS OF CONTRACT

PURPOSE OF CHANGE ORDER:
The recent completion of stormwater improvements in the Woodlands subdivision provides an opportunity
to add Umbrella Tree Lane to the Phase III Street Resurfacing Workplan, The timely addition of this
segment to the Workplan will allow the contractor to complete the work while currently mobilized in the
subdivision and avoid any costs associated with re -mobilization should the segment be added in a later
phase of the construction schedule.
The project budget as authorized by the City Commission provided a construction contingency in the
amount of $185,882.91. The amount of this contingency is sufficient to offset cost associated with the
implementation of the change order.
