R-20.01-165 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A SPECIAL EXCEPTION TO ALLOW FOR THE PROVISION OF TWO (2) RENTAL TRUCKS TO BE MADE AVAILABLE TO PATRONS OF THE BUDGET MINI -STORAGE FACILITY LOCATED AT 8300 NORTH UNIVERSITY DRIVE IN A B-3 (GENERAL BUSINESS DISTRICT) ZONING CATEGORY; SPECIFICALLY LOTS 4-8 INCLUSIVE, BLOCK 12 OF THE "LYONS COMMERCIAL SUBDIVISION NO. 3" PLAT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 76, PAGE 31 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; CASE NO. 8-Z-01; PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code of the City of Tamarac approves the granting of a special exception to allow for the provision of two (2) rental trucks to be made available to patrons of the Budget Mini -Storage Facility located at 8300 North University Drive in a B-3 (General Business District) zoning category; specifically Lots 4-8 inclusive, Block 12 of the "Lyons Commercial Subdivision No. 3" Plat, according to the Plat thereof as recorded in Plat Book 76, Page 31 of the Public Records of Broward County, Florida; and WHEREAS, the Planning Board held a public hearing on June 6, 2001, thereon and has recommended approval of this application; and June 12, 2001, 2001 - Temp Reso #9424 2 WHEREAS, the Director of Community Development recommends approval of this application; and WHEREAS, the City Commission of the City of Tamarac finds that approving the petition for special exception would be in keeping with the public health, safety and general welfare of the City of Tamarac; and WHEREAS, the City Commission has examined and investigated the application and staff recommendation dated June 12, 2001; and WHEREAS, the City Commission reviewed the Special Exception request and accompanying documents at a public meeting; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to issuance of a certificate of occupancy for the development; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant a special exception to allow for the provision of two (2) rental trucks to be made available to patrons of the Budget Mini -Storage Facility located at 8300 North University Drive in a B-3 (General Business District) zoning category; specifically Lots 4-8 inclusive, Block 12 of the "Lyons Commercial Subdivision No. 3" Plat, according to the Plat thereof as recorded in Plat Book 76, Page 31 of the Public Records of Broward County, Florida. L.] 1-1 June 12, 2001, 2001 - Temp Reso #9424 3 I I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby grants a Special Exception to allow for the provision of two (2) rental trucks to be made available to patrons of the Budget Mini -Storage Facility located at 8300 North University Drive in a B-3 (General Business District) zoning category; specifically Lots 4-8 inclusive, Block 12 of the "Lyons Commercial Subdivision No. 2" Plat, according to the Plat thereof as recorded in Plat Book 76, Page 3 of the Public Records of Broward County, Florida; Case No. 8-Z-01; subject to the following conditions: SECTION 3: Conditions of approval: 1, Apply for and receive approvals of all appropriate Occupational Licenses and pay all applicable fees for the provision of two (2) rental trucks pursuant to Section 12-37 of the City of Tamarac Code of Ordinances. 2. The two (2) rental trucks must be stored in the designated spaces interior to the buildings at all times (including pick up and drop-off). The trucks are prohibited Ifrom being parked in the required parking spaces which may be visible from June 12, 2001, 2001 - Ternp Reso #9424 4 I either abutting properties or University Drive. 3. The trucks are made available for rental only to patrons of the Budget Mini - Storage facility which have executed lease agreements of storage units at the Budget Mini -Storage facility. 4. No advertising will be permitted on the exterior of the building regarding the availability of the trucks for rental. 5. The maximum permitted length of proposed trucks is limited totwenty-four(24') feet in length. 6. No vehicle maintenance or repair is permitted to be conducted on the premises. 7. No trucks, other than emergency vehicles, are permitted in the rear of the building. 8. Additionally, any approval of the Special Exception shall be subject to revocation, if it is determined that the rental operation is not performed in accordance with these conditions. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or I I I June 12, 2001, 2001 - Temp Reso #9424 5 application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: passage and adoption. This Resolution shall become effective immediately upon its PASSED, ADOPTED AND APPROVED this 27 1h day of June, 2001.
