R-2001-204 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A LIMITED PARKING WAIVER TO ALLOW THIRTEEN (13) PARKING SPACES AND TWO (2) LOADING SPACES (12' X 60') TO SERVE A PROPOSED 84,600 SQUARE FOOT COMPONENT PASSIVE SELF -STORAGE FACILITY TO SAFEGUARD SELF -STORAGE FACILITY, LOCATED AT WEST COMMERCIAL BOULEVARD, EAST OF NW 63 AVENUE; SPECIFICALLY PARCELS "A" AND "B" OF THE "FOUNTAINS CORPORATE CENTER" PLAT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 139, PAGE 44 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; CASE NO, 15-Z-01; PROVIDING FOR CONDITION OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 24 of the City of Tamarac Code of Ordinances provides that the City Commission may grant a limited waiver of the off street parking and loading requirements whenever a hardship would exist by adhering to strict application thereof, and further provides that the waiver would not be detrimental to public safety, health and welfare of the citizens of the City; and WHEREAS, a hardship exists for the Safeguard Self -Storage Facility located at West Commercial Boulevard, east of NW 63 Avenue; and WHEREAS, current parking space requirements would require in excess of 500 June 27, 2001 - Temp Reso #9444 2 Revision No. 1 - July 2, 2001 parking spaces and six (6) loading spaces for the proposed self -storage facility, thereby rendering the project infeasible; and WHEREAS, Safeguard Self -Storage, Inc. prepared a study analyzing parking at fifteen (15) self -storage facilities which indicated that the maximum peak demand at two (2) out of fifteen (15) facilities was seven (7) parking spaces at one (1) time, thereby supporting the request for a limited parking waiver; and WHEREAS, the Planning Board has held a public hearing on June 26, 2001, thereon and has recommended approval of this application; and WHEREAS, the Director of Community Development has thoroughly reviewed and recommends approval of this application; and WHEREAS, the City Commission desires to take action on the limited parking waiver requested in the application by Safeguard Self -Storage Facility to allow thirteen (13) parking spaces and two (2) loading spaces (12' x 60') to serve a proposed 84,600 square foot component passive self -storage facility to the Safeguard Self -Storage Facility; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the limited parking waiver. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and 1 �J 1 1 1 June 27, 2001 - Temp Reso #9444 3 Revision No. 1 - July 2, 2001 confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the application granting approval of a limited parking waiver to allow thirteen parking spaces and two (2) loading spaces (12' x 60') to serve a proposed 84,600 square foot component passive self -storage facility to Safeguard Self - Storage Facility, located at West Commercial Boulevard, east of NW 63 Avenue; is HEREBY APPROVED. SECTION 3: The application is subject to the following condition: The requested Limited Parking Waiver is based upon demand for parking at fifteen (15) similarly sized facilities located throughout the United States. The Director of Community Development shall monitor the demand for parking at the subject property for a period not to exceed two (2) years from the date of issuance of a Certificate of Occupancy for the proposed facility to ensure the adequacy of the off-stmet parking facilities on the subject property to serve the proposed development. In the event that the Director of Community Development determines the off-street parking facilities are not adequate to serve the proposed development, the applicant must prepare a parking study for the subject property and provide additional off-street parking facilities as may be necessary to serve the proposed development. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution June 27, 2001 - Temp Reso #9444 4 Revision No. 1 - July 2, 2001 is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 22nd day of August, 2001.
