CITY OF TAMARAC
RESOLUTION NO. R-2001-213
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO PERMIT THE TAMARAC CHAMBER OF
COMMERCE AND/OR DESIGNEE TO SELL AND SERVE BEER
AT THEIR TAMARAC DAYS EVENTS TO BE HELD AT
TAMARAC PARK, 7501 NORTH UNIVERSITY DRIVE, ON
SATURDAY, OCTOBER 27, 2001, FROM 10:00 A.M. THROUGH
5:00 P.M. AND SUNDAY, OCTOBER 28, 2001, FROM 12:01 P.M.
THROUGH 4:00 P.M.; PROVIDING FOR PROPER INSURANCE
AND HOLD HARMLESS AGREEMENT; PROVIDING FOR
SECURITY AT THE BEER SERVICE TRUCKS; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Manager's Office has received a request from the Tamarac
Chamber of Commerce to sell beer at their Tamarac Days events scheduled for Saturday,
October 27, 2001 and Sunday, October 28, 2001, a copy of said request is attached as Exhibit
A; and
WHEREAS, the Tamarac Chamber of Commerce will have vendors at the Tamarac
Days events and wishes to serve and sell beer to the attendees of this event; and
WHEREAS, in Section 15-88 (a) of the City of Tamarac Code, it states that a permit for
the consumption or sale of alcoholic beverages at group functions must be obtained from the
City Commission; and
WHEREAS, Section 3-2 of the City of Tamarac Code prohibits the sale of alcoholic
beverages from 2:01 a.m. to 12:00 noon, local time, on Sundays; and
WHEREAS, the City's Risk Management department will insure the appropriate levels of
insurance coverage for this event will be obtained; and
WHEREAS, the Parks and Recreation Director and the City Manager recommend a
permit be granted to the Tamarac Chamber of Commerce and/or designee to sell and serve

beer at the Tamarac Days events provided all other appropriate permits are applied for and
approved; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the
best interests of the citizens and residents of the City of Tamarac, to permit the Tamarac
Chamber of Commerce and/or designee to sell and serve beer at the Tamarac Days events to
be held at Tamarac Park October 27-28, 2001.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this resolution.
SECTION 2: That subject to the conditions in Sections 3 and 4, the request to permit
the Tamarac Chamber of Commerce and/or designee to sell and serve beer at the Tamarac
Days events from 10:00 a.m. through 5:00 p.m. on Saturday, October 27, 2001 and 12:01 p.m.
through 4:00 p.m. on Sunday, October 28, 2001, at Tamarac Park, provided all other
appropriate permits are applied for and approved, is HEREBY APPROVED.
SECTION 3: That insurance coverage in a form and amount acceptable to the City's
Risk Manager and an executed hold harmless agreement in a form acceptable to the City's Risk
Manager be provided to the City before the event.
SECTION 4: That the Tamarac Chamber of Commerce shall provide security at the
service trucks during sale hours.
SECTION 5: That all resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.

SECTION 6: If any clause, section, other part of application of this Resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it
shall not affect the validity of the remaining portion or applications of this Resolution.
SECTION 7: This Resolution shall become effective immediately upon adoption.
PASSED, ADOPTED AND APPROVED this 22"d day of August, 2001.
