R-2001-221 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO RELEASE A PUBLIC IMPROVEMENT PERFORMANCE BOND IN THE FORM OF CHECK #1101 IN THE AMOUNT OF $3,563.60 POSTED BY T & H ACQUISITIONS, L.L.C., FOR SIDEWALK AND CURB IMPROVEMENTS FOR THE T & H OFFICE BUILDING PROJECT LOCATED ON THE SOUTHEAST CORNER OF MCNAB ROAD AND BROOKWOOD BOULEVARD, SUBJECT TO THE RECEIPT OF A ONE-YEAR WARRANTY BOND IN THE AMOUNT OF $890.90; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, T & H Acquisitions, L.L.C., has constructed the sidewalk and curb improvements at the T & H Office Building Project in accordance with the Site Plan approved by the City Commission on November 08, 2000 through resolution number R- 2000-299; and WHEREAS, the sidewalk and curb Improvements were inspected and found to be acceptable according to the requirements of the City Code; and WHEREAS, T & H Acquisitions, L.L.C., has requested the release of this Public Improvement Performance Bond in the form of a Check # 1101 from T & H Acquisitions, L.L.C., as Surety, in the amount of $3,563.60, a copy of which is attached hereto as "Exhibit A", subject to the receipt of a one-year Warranty Bond in the amount of $980.90 to the City Of Tamarac for the construction of Sidewalk and Curb improvements for the T & H Office Building Project; and \\Dellone\udderk\Dawn\Legislation 2001\Resolutions\Hugust 22\9485.doc August 22, 2001 - Temp. Reso. #9485 Page 2 of 3 WHEREAS, it is the recommendation of the Director of Public Works and the Assistant City Engineer that that Public Improvements Performance Bond be released for the T & H Office Building project for sidewalk and curb improvements, subject to the receipt of a one-year Warranty Bond from T & H Acquisitions, L.L.C.; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to release the Public Improvement Performance Bond in the form of Check #1101 from T & H Acquisitions, L.L.C., in the amount of $3,563.60 for the construction of sidewalk and curb improvements at the T & H Office Building project, subject to the receipt of a one-year Warranty Bond from T & H Acquisitions, L.L.C. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The appropriate City Officials are hereby authorized to release a Public Improvement Performance Bond in the form of Check #1101 from T & H Acquisitions, L.L.C., in the amount of $3,563.60 for the construction of sidewalk and curb improvements, subject to the receipt and acceptance of a Warranty Bond in the amount of $890.90 for the T & H Office Building project in accordance with Section 10-156 of the City Code. Reso. #9485 Page 3 of 3 lJ 1 Section 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
