R2001-226 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING ONE REGULAR MEMBER TO THE BOARD OF ADJUSTMENT TO FILL AN UNEXPIRED THREE-YEAR TERM UNTIL JULY 16, 2004; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission is desirous of appointing one (1) regular member to the Board of Adjustment to fill an unexpired term until July 16, 2004; and WHEREAS, in accordance with Sections 24-36 and 24-37 of the Tamarac Code (attached hereto as Exhibit A) members of the Board of Adjustment shall be appointed by the City Commission and serve for overlapping terms of three (3) years or thereafter until their successors are appointed; and WHEREAS, in accordance with Section 24-37(c) of the Tamarac Code any vacancy occurring during the unexpired term of office of any member shall be filled by the City Commission for the remainder of the term; and WHEREAS, the Community Development Director and City Manager recommend approval; and 3 WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interest of the citizens and residents of the City of Tamarac to appoint Temp. Reso. #9461 Page 2 July 24, 2001 one (1) regular member to the Board of Adjustment to fill an unexpired three-year term until July 16, 2004. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS' clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That pursuant to Section 24-37 of the Tamarac Code, the following person is hereby appointed as a member of the Board of Adjustment to fill an unexpired term until July 16, 2004, or until such time as reappointment is u"F..T•'l1 Henry Rohr SECTION 3: The Board of Adjustment shall elect a chair and vice -chair from among its members. SECTION 4: All resolutions or parts of resolutions in conflict herewith are' hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 1 Temp.
