A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING A
VACATION OF EASEMENT TO ALLOW THE
ABANDONMENT OF TWO (2) EXISTING TWELVE
FOOT (12') WATERLINE EASEMENTS (PER
OFFICIAL RECORDS BOOK (ORB)10428, PAGE 543
BROWARD COUNTY PUBLIC RECORDS (BCPR)
AND PER PLAT BOOK 81, PAGE 23 BCPR), ONE (1)
TWELVE FOOT (12') SANITARY SEWER EASEMENT
(PER PLAT BOOK 81, PAGE 23 BCPR), AND ONE (1)
TWELVE FOOT (12') FP&L EASEMENT (PER ORB
4783, PAGE 524 BCPR), GENERALLY LOCATED ON
THE SOUTH SIDE OF LAGOS DE CAMPO
BOULEVARD, WEST OF NW 84 TERRACE;
SPECIFICALLY A PORTION OF PARCELS "A" AND
"R" OF THE "WEDGES OF TAMARAC" PLAT,
ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 81, PAGE 23 OF THE
PUBLIC RECORDS OF BROWARD COUNTY,
FLORIDA; CASE NO. 3-P-01; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Easements described in Exhibit "1" were dedicated to the public on
November 13, 1973 at the time of the initial recordation of the Plat, as well as subsequent
to Plat recordation; and
WHEREAS, the property owner, Fidel Gomez, has determined that the two (2)
existing twelve foot (12') waterline easements (per Official Records Book (ORB) 10428,
Page 543 Broward County Public Records (BCPR) and per Plat Book 81, Page 23 BCPR),
one (1) twelve foot (12') sanitary sewer easement (per Plat Book 81, Page 23 BCPR), and
August 2, 2001 - Temp Reso #9458 2

one (1) twelve foot (12') FP&L easement (per ORB 4783, Page 524 BCPR), generally
located on the south side of Lagos de Campo Boulevard, west of NW 84 Terrace (as
depicted in Exhibit I ") are no longer needed and that new easements shall be dedicated
upon the filing of the site plan; and
WHEREAS, the City Engineer and franchised Utility Companies have been
contacted and all have stated no objection to the requested vacation of two (2) existing
twelve foot (12') waterline easements (per ORB 10428, Page 543 BCPR and per Plat Book
81, Page 23 BCPR), one (1) twelve foot (12') sanitary sewer easement (per Plat Book 81,
Page 23 BCPR), and one (1) twelve foot (12') FP&L easement (per ORB 4783, Page 524
BCPR), generally located on the south side of Lagos de Campo Boulevard, west of NW 84
Terrace, to facilitate any future improvements; and
WHEREAS, the Director of Community Development recommends approval of this
vacation of easement; and
WHEREAS, the Planning Board recommended approval on August 1, 2001; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant the vacation
of easement to allow the abandonment of two (2) existing twelve foot (12') waterline
easements (per ORB 10428, Page 543 BCPR and per Plat Book 81, Page 23 BCPR), one
(1) twelve foot (12') sanitary sewer easement (per Plat Book 81, Page 23 BCPR), and one
(1) twelve foot (12') FP&L easement (per ORB 4783, Page 524 BCPR), generally located
on the south side of Lagos de Campo Boulevard, west of NW 84 Terrace; specifically a

portion of Parcels "A" and "R" of the "Wedges of Tamarac" Plat, according to the Plat
thereof as recorded in Plat Book 81, Page 23 of the Public Records of Broward County,
Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the vacation of easements to allow the abandonment of
two (2) existing twelve foot (12') waterline easements (per ORB 10428, Page 543 BCPR
and per Plat Book 81, Page 23 BCPR), one (1) twelve foot (12') sanitary sewer easement
(per Plat Book 81, Page 23 BCPR), and one (1) twelve foot (12') FP&L easement (per ORB
4783, Page 524 BCPR) (attached hereto as Exhibit 1"), generally located on the south
side of Lagos de Campo Boulevard, west of NW 84 Terrace; specifically a portion of
Parcels "A" and "R" of the "Wedges of Tamarac" Plat, according to the Plat thereof as
recorded in Plat Book 81, Page 23 of the Public Records of Broward County, Florida; Case
No. 3-P-01; is hereby granted.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
August 2, 2001 - Temp Reso #9458 4
Revision No. 1 — August 9, 2001
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

WHEREAS, pursuant to a notice of public hearing, duly and regularly
advertised in accordance with law, a public hearing was held in the Commission
Meeting Room No. 422, Broward County Governmental Center located at 115 S.
Andrews Avenue, Fort Lauderdale, Florida, on Tuesday, February 10, 2004 at
2:00 P.M. to consider the advisability of renouncing and disclaiming all right of
County and the public to and in the public portion of Water line Easement,
hereafter described.
WHEREAS, after hearing all interested parties and determining that the
proposed action will not materially interfere with the County road system and will
not affect the ownership of or deprive any person convenience access to hi/her
premises, in accordance with the Florida Statutes (as amended from time to
time) it was determined that it would be to the best interest of all concerned to
renounce, disclaim, vacate and abandon any right to the County and the public to
and in the following described Water Line Easement, lying and being in Broward
County, Florida, NOW, THEREFORE,
BE IT RESOLVED by the Board of County Commissioners of Broward
County, Florida, that:

WHEREAS, pursuant to a notice of public hearing, duly and regularly advertised
in accordance with law, a public hearing was held in the Commission Meeting Room No.
422, Broward County Governmental Center located at 115 South Andrews Avenue, Fort
Lauderdale, Florida, on Tuesday. April 8, 2003 at 2:00 P.M. to consider the advisability
of renouncing and disclaiming all right of County and the public to and in the public portion
of utility easements_, hereafter described.
WHEREAS, after hearing all interested parties and determining that the
proposed action will not materially interfere with the County road system and will not affect
the ownership of or deprive any person convenient access to his/her premises, in
accordance with the Florida Statutes (as amended from time to time) it was determined
that it would be to the best interest of all concerned to renounce, disclaim, and abandon
any right to the County and the public to and in the following described utilily easements
