Reso. #9250 1 Revision No. 1 — February 6, 2001 CITY OF TAMARAC, FLORIDA RESOLUTION NO, 13-2001-0im A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, REQUESTING THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) TO INSTALL A PROTECTIVE BARRIER ALONG THE NORTHERN BOUNDARY OF WEST COMMERCIAL BOULEVARD BEGINNING AT NW 49 AVENUE AND EXTENDING WEST TO NW 50 AVENUE; PROVIDING FOR TRANSMITTAL OF THIS RESOLUTION TO THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), BROWARD COUNTY BOARD OF COUNTY COMMISSIONERS AND BROWARD COUNTY TRANSPORTATION PLANNING DIVISION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Policy 1.3 of the Transportation Element of the City's adopted Comprehensive Plan states that the City shall request the Broward County Board of County Commissioners, the Broward County Transportation Planning Division and the Florida Department of Transportation (FDOT) to make road improvements to trafficways in Tamarac as determined by the City; and WHEREAS, the City has received numerous complaints from homeowners north of Commercial Boulevard between NW 49 Avenue and NW 50 Avenue regarding hazardous conditions and negative impacts due to the traffic headed westbound on Commercial is Boulevard; and January 17, 2001 - Temp. Reso. #9250 2 Revision No. 1 - February 6, 2001 0 WHEREAS, this section of Commercial Boulevard is located immediately west of the Florida Turnpike overpass; and WHEREAS, westbound traffic crossing the Florida Turnpike overpass at Commercial Boulevard generates significant noise, vibration, and debris which creates significant negative impacts to single family residences located on the north side of Commercial Boulevard; and WHEREAS, several years ago many Australian Pine Trees as well as other landscaping which was previously planted along the northern boundary of Commercial Boulevard which previously provided a protective buffer from the negative impacts associated with the location of the existing single family homes in close proximity to Commercial Boulevard were removed; and WHEREAS, traffic congestion and noise have significantly increased over the past several years; and WHEREAS, increased traffic volume and congestion have resulted in approximately seventy-eight (78) vehicular accidents on Commercial Boulevard between NW 49 Avenue and NW 50 Avenue in the past three (3) years; and WHEREAS, the Director of Community Development, the Chief of Police and the Director of Public Works recommend approval of this request; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to request the State 0 • • I] January 17, 2001 - Temp. Reso. #9250 3 Revision No. 1 - February 6, 2001 of Florida Department of Transportation (FDOT) to install a protective barrier along the northern boundary of West Commercial Boulevard beginning at NW 49 Avenue and extending west to NW 50 Avenue; providing for transmittal of this Resolution to the State of Florida Department of Transportation (FDOT), Broward County Board of County Commissioners and Broward County Transportation Planning Division. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission of the City of Tamarac hereby requests the State of Florida Department of Transportation (FDOT) to install a protective barrier along the northern boundary of West Commercial Boulevard beginning at NW 49 Avenuv&�eotanding west -NW 50 Avenue. - I'°•, .. t'E=N 3: The City Clerk is hereby authorized to transmit copies of this Pill r Resolution too t� Flca�rid Department of Transportation (FDOT), Broward County Board of Cound therBfoWard County Transportation Planning Division. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. January 17, 2001 - Temp. Reso. #9250 4 Revision No. 1 - February 6, 2001 SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 14 day of February, 2001.
