CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2001-287
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO RELEASE A PUBLIC
IMPROVEMENT PERFORMANCE BOND IN THE FORM OF
CHECK #4775 IN THE AMOUNT OF $5,296.00 FOR THE
WATER DISTRIBUTION SYSTEM IMPROVEMENTS
INSTALLED BY SPRINKLERMATIC AUTOMATIC FIRE
SPRINKLERS, INC., FOR THE DAVID'S CUSTOM
CATERERS PROJECT LOCATED AT 6501 WEST
COMMERCIAL BOULEVARD; WAIVING THE
REQUIREMENT FOR THE RECEIPT OF A ONE YEAR
WARRANTY BOND; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Sprinklermatic Automatic Fire Sprinklers, Inc., has completed the
construction of the Water Distribution System Improvements for the David's Custom
Caterers Project located at 6501 West Commercial Boulevard (attached hereto in map
form as "Exhibit 1"); and
WHEREAS, the terms of section 10-156 of the City Code requires
Sprinklermatic Automatic Fire Sprinklers, Inc., to provide a Public Improvement
Performance Bond to the City of Tamarac (a copy of which is attached hereto as
"Exhibit 2") for the David's Custom Caterers Project Water Distribution System
Improvements; and

WHEREAS, Section 10-156 required that a one year Warranty Bond be issued
upon release of the Public Improvement Performance Bond; and
and
WHEREAS, the one year Warranty Bond for this Project would be $1,324.00;
WHEREAS, Sprinklermatic Automatic Fire Sprinklers, Inc., has requested the
release of the Public Improvement Performance Bond in the form of Check #4775 in the
amount of $5,296 (a copy of which is attached hereto as Exhibit 2); and
WHEREAS, the Water Distribution System Improvements have been inspected,
approved and already placed into service by the Utilities Engineering Division; and
WHEREAS, the Water Distribution System Improvements have been in service
for over one year, the Utilities Department is requesting the requirement for the receipt
of a one year warranty bond in the amount of $1,324 required by City Code Section 10-
156 and the Water and Sewer Developer's Agreement be waived; and
WHEREAS, it is the recommendation of the Director of Utilities that the Public

Improvement Performance Bond be released for the David's Custom Caterers Project
Water Distribution System Improvements and the one year Warranty Bond requirement
be waived; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be
in the best interest of the citizens and residents of the City of Tamarac to release the
Public Improvement Performance Bond from Sprinklermatic Automatic Fire Sprinklers,
Inc., for the David's Custom Caterers Project Water Distribution System Improvements
and to waive the requirement for the receipt of a one-year Warranty Bond.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution.
SECTION 2: The appropriate City Officials are hereby authorized to
release the Public Improvement Performance Bond in the amount of $5,296.00 for the

Water Distribution System Improvements for the David's Custom Caterers Project.
SECTION 3:
The requirements for receipt of a one year warranty bond for
the Water Distribution System Improvements is hereby waived.
SECTION 4: That City Clerk is hereby authorized and directed to release
to the Utilities Department for return to Sprinklermatic Automatic Fire Sprinklers, Inc.,
the Public Improvement Performance Bond for the David's Custom Caterers Project.
The bond is in the form of Check #4775 in the amount of $5,296.00 for the Water
Distribution System Improvements located at 6501 Commercial Boulevard.
SECTION 5: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions or
applications of this Resolution.

SECTION 7: This Resolution shall become effective immediately upon its
passage and adoption.
