R-2001 - 306 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE TAMARAC DIVISION OF THE BROWARD COUNTY SHERIFF'S OFFICE TO USE LAW ENFORCEMENT TRUST FUND MONIES TO PURCHASE A TRAILER MOUNTED GENERAL PURPOSE MESSAGE BOARD AT A TOTAL COST NOT TO EXCEED $22,000.00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac desires to improve the movement of traffic and the safety of its citizens within the City limits; and WHEREAS, the Broward Sheriff's Office ( "BSO") needs a Trailer Mounted General Purpose Message Board ( "Message Board") to meet the desired level of safety of the citizens of Tamarac; and WHEREAS, the City of Tamarac does not currently own such a Message Board; and WHEREAS, this type of Message Board has proven to be of great benefit in directing and warning motorists of traffic conditions; and WHEREAS, Broward Sheriffs Office District VII Chief has requested the use of LETF funds to purchase a Message Board by the Broward Sheriff's Office Purchasing Division in an amount not to exceed $22,000 (attached hereto as Exhibit 1); and Temp. Reso. #9532 October 5, 2001 Page 2 of 4 Revision: 10/16/01 1 WHEREAS, LETF funds are available for the purchase of the Message Board; and WHEREAS, appropriate uses of LETF monies are outlined in Florida Statute 932.7055; and WHEREAS, the Broward Sheriffs Office will use Law Enforcement Trust Fund ("LETF") monies to purchase the Message Board as specified in Florida Statute 932.7055, and the purchase of the Message Board falls within these guidelines; and WHEREAS, approval of this Resolution will grant the Broward Sheriffs Office the authority to utilize said LETF funds to purchase the Message Board through it's Purchasing Division; and WHEREAS, it is the recommendation of the Tamarac District Chief and the Director of Finance that this specific use of Law Enforcement Trust Fund monies be allowed in order to purchase a Message Board at a total cost not to exceed $22,000; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac for BSO to purchase the Message Board through its Purchasing Division utilizing LETF monies at a total cost not to exceed $22,000. �J 1 1 Temp. Reso. #9532 October 5, 2001 Page 3 of 4 Revision: 10/16/01 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The appropriate City Officials are hereby authorized to grant permission through passage of this Resolution for the Tamarac District of the Broward Sheriffs Office to purchase through it's Purchasing Division, one Trailer Mounted General Purpose Message Board utilizing LETF monies in an amount not to exceed $22,000. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Dugger Li District VII - Tamarac SUBJECT: Law Enforcement Trust Fund Expenditures Request In accordance with Article 13 of the Contractual Agreement for Services Between the Broward Sheriffs Office and the City of Tamarac, the attached you will find a traffic message board trailer, which has been identified for purchase from funds from the Law Enforcement Trust Fund. The equipment purchased will enhance the daily operations of the district and is not available through current budget appropriations or grant funding. PURCHASE ORDER LETF01-002/IMA-GA: Traffic enforcement is a major responsibility of the Broward Sheriffs Office. In an effort to reduce traffic crashes and fatalities we are requesting approval to expend Law Enforcement Trust Funds to purchase an Imaging/Message Board to place along traffic ways to remind, alert and/or warn motorists of hazards or alternate emergency routes. In areas of Broward County where this message board has been used, a significant decrease in accident crashes has been measured. This board would greatly enhance the Broward Sheriffs Office District 7's ability to educate and warn the motoring public in and effort to reduce accidents and fatalities. Below is the total amount of funds requested: MESSAGING BOARD TRAILER- 22,000.00 Please see the attached documentation regarding a detailed description of equipment for the requested funds. Per our agreement, items purchased with Law Enforcement Trust Funds remain the property of the City of Tamarac. Expenditures for this equipment is authorized under State Statute 932.7055.
