R-2001-316 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A LIMITD PARKING WAIVER OF SIXTY (60) REQUI14ED PARKING SPACES TO LAKESIDE PLAZA SHOPPING CENTER FOR THE PROPOSED BETHESDA SANCTUARY AND TOPS CELEBRITY SALON, LOCATED AT 5455 NORTH STATE ROAD #7; SPECIFICALLY LOT "A" OF THE "LAKESIDE AT TAMARAC' PLAT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 115, PAGE 32 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (CASE NO. 21-Z-01); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 24 of the City of Tamarac Code of Ordinances provides that the City Commission may grant a limited waiver of the off street parking and loading requirements whenever a hardship would exist by adhering to strict application thereof, and further provides that the waiver would not be detrimental to public safety, health and welfare of the citizens of the City; and WHEREAS, a hardship exists for the Lakeside Plaza Shopping Center located at 5455 North State Road #7; and WHEREAS, current parking space requirements would require in excess of sixty (60) required parking spaces for the proposed Bethesda Sanctuary and Tops Celebrity 1 1 October 5, 2001 - Temp Reso #9558 2 Revision No. 1 - October 12, 2001 Revision No. 2 - October 24, 2001 Salon; and WHEREAS, Lakeside Plaza Shopping Center prepared a study analyzing parking at Lakeside Plaza Shopping Center, thereby supporting the request for a limited parking waiver; and WHEREAS, the Planning Board has held a public hearing on October 3, 2001, thereon and has recommended approval of this application; and WHEREAS, the Director of Community Development has thoroughly reviewed and recommends approval of this application; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the limited parking waiver requested in the application by Lakeside Plaza Shopping Center to allow sixty (60) required parking spaces to serve the proposed Bethesda Sanctuary and Tops Celebrity Salon. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the application granting approval of a limited parking 1 1 1 October 5, 2001 - Temp Reso #9558 Revision No. 1 - October 12, 2001 Revision No. 2 - October 24, 2001 3 waiver of sixty (60) required parking spaces to Lakeside Plaza Shopping Center for the proposed Bethesda Sanctuary and Tops Celebrity Salon, located at 5455 North State Road #7; is HEREBY APPROVED. SECTION 3: Conditions of approval: 1. The applicant shall be required to meet with City staff and any additional signage determined to be necessary shall be installed by the applicant prior to issuance of a Certificate of Occupancy. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
