CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2001-365
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING A
VACATION OF EASEMENT OF A FIFTEEN FOOT
(15') UTILITY EASEMENT LOCATED WITHIN A
CONSERVATION DRAINAGE EASEMENT AREA
WEST OF HIATUS ROAD BETWEEN MCNAB ROAD
AND COMMERCIAL BOULEVARD, SPECIFICALLY
TRACT "B" OF THE "WESTPOINT SECTION 7" PLAT,
ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 162, PAGE 23 OF THE
PUBLIC RECORDS OF BROWARD COUNTY,
FLORIDA (CASE NO. 10-P-01); PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Conservation Drainage Easement described in Exhibit "1" was
dedicated to the public on January 15, 1997 at the time of the initial recordation of the Plat;
and
WHEREAS, the property owner, West Point Land, L.L.C., has determined that the
vacation of the fifteen foot (15') utility easement located within a conservation drainage
easement area west of Hiatus Road between McNab Road and Commercial Boulevard (as
depicted in Exhibit "1 ") has been requested by Broward County as part of the dedication;
and
WHEREAS, the City Engineer has been contacted and has stated no objection to
the vacation of the fifteen foot (15') utility easement located within a conservation drainage
easement area west of Hiatus Road between McNab Road and Commercial Boulevard to
facilitate any future improvements; and

WHEREAS, the Director of Community Development recommends approval of this
vacation of easement; and
WHEREAS, the Planning Board recommended approval on December5, 2001; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant the vacation
of easement of the fifteen foot (15') utility easement located within a conservation drainage
easement area west of Hiatus Road between McNab Road and Commercial Boulevard,
specifically Tract "B" of the "Westpoint Section 7" Plat, according to the Plat thereof as
recorded in Plat Book 162, Page 23 of the Public Records of Broward County, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the vacation of easement of the fifteen foot (15') utility
easement located within a conservation drainage easement area (attached hereto as
Exhibit "'I") west of Hiatus Road between McNab Road and Commercial Boulevard,
specifically Tract "B", of the "Westpoint Section 7" Plat, according to the Plat thereof as
recorded in Plat Book 162, Page 23 of the Public Records of Broward County, Florida; is
hereby granted.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

A portion of Tract 'B', of "WESTPOINT SECTION 7 PLAT according to the Plat thereof as recorded in
Plot Book 162. Page 23 of the public records o/ Broward County, Florida, being more particularly described as
follows:
COMMENCE. at the Northwesternmost Carver of said Tract '8'; Thence along the North boundary of said Tract
'8' North 89°I9'54" East (Plat Bearing) B95.23 feet; thence departing said boundary South 00°40'06" East
120,00 feet to the POINT OF BEGINNING: thence Parallel with and 120.00 feet South of the North boundary
of said Tract V. North 89"19'54" East 1345.37 feet to a point on a 887.00 foot radius non -tangent curve
concave to the Southwest whose radius point bears South 61PO4'36" West; thence Southeasterly along said
curve, through a central angle of 0I°05'40" an arc distance of 16.94 feet to a point of non-tongency; thence
parallel with and 135.00 feet South of the aforesaid North boundary South 89°19'54" West 1338.24 feet;
thence parallel with and 15.00 feet East of the boundary of said tract 'B" South 00°40'06" East 401.40 feet:
thence porollel with and 17.40 feet south of the South line of a 401.40 foot wide Conservation/Drainage
Easement as shown on said plat; thence along said parallel line. South 89°19'54" West 15.00 feet to the West
boundary of said Tract 'B': thence along said West boundary, North 00"40'06" West 418.80 feet to the Point
of Beginning.
