R-2001 - 44 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ACCEPTING ONE AUTOMATIC EXTERNAL DEFIBRILLATOR FROM THE AMERICAN HEART ASSOCIATION; AUTHORIZING THE TRANSFER OF THE SAME TO KINGS POINT IN TAMARAC, INC., PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac desires to support the provision of timely and effective emergency medical care; and WHEREAS, the availability of early defibrillation provides for an increased chance of survival from certain heart arrhythmias; and 0 WHEREAS, Automatic External Defibrillators (AED) coupled with proper training provide the opportunity for early intervention; and WHEREAS, the North Broward Hospital District has provided one Automatic External Defibrillator for use at the Kings Point Clubhouse to the American Heart Association; and WHEREAS, the American Heart Association is prohibited from making a direct donation of the AED to Kings Point; and WHEREAS, the American Heart Association has provided the same AED to the City of Tamarac for use at the Kings Point Clubhouse and has requested that the City of Tamarac act as a conduit and donate the AED to Kings Point in Tamarac, Inc. (Kings Point); and 0 Temp. Reso. #9299 February 28, 2001 Rev.#1 WHEREAS, Kings Point desires to provide and maintain the availability of 0 early defibrillation through the use of an AED to the users of its Clubhouse; and WHEREAS, Kings Point has trained personnel in the use of AEDs in accordance with Florida State Statutes and the manufacturer's recommendations and has committed to maintain the AED in safe and operable condition; and WHEREAS, The City of Tamarac desires to transfer possession and ownership of the same AED as requested by the American Heart Association to Kings Point for use at the Kings Point Clubhouse; and WHEREAS, Kings Point and all other appropriate parties will be required to sign a Hold Harmless and Indemnification Agreement, agreeing to indemnify and hold harmless the City of Tamarac, prior to receiving the AED; and WHEREAS, it is the recommendation of the Fire Chief that Tamarac transfer ownership of the AED to Kings Point for use at their Clubhouse; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept from the American Heart Association an AED and, acting as a conduit, to grant same to Kings Point, thereby complying with the intent of the North Broward Hospital District and the American Heart Association that Kings Point receive the AED for use in its clubhouse. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: El Temp. Reso. #9299 February 28, 2001 Rev.#1 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and in true and correct and are hereby made a specific art of this confirmed as being y p p Resolution. SECTION 2: The City of Tamarac does hereby accept from the American Heart Association and transfer possession and ownership of one Automatic External Defibrillator donated by the North Broward Hospital District through the American Heart Association to Kings Point in Tamarac, Inc., for use at the Kings Point Clubhouse at 7620 Nob Hill Road, Tamarac, Florida, subject to receipt by the City of the appropriate hold harmless and indemnification agreement from Kings Point. SECTION 3: The Mayor and the City Manager or his designee are hereby authorized to execute any and all agreements reviewed and approved by the City Attorney and required to accomplish the intent of this resolution. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in. part ..or application, it shall not affect the validity of the remaining portions°oraprpiications of this Resolution. 0 Temp.
