CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2001- &�
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, REPEALING
RESOLUTION NO. 2001-46; AUTHORIZING THE RETURN
OF ONE AUTOMATIC EXTERNAL DEFIBRILLATOR TO
NORTH BROWARD HOSPITAL DISTRICT THROUGH THE
AMERICAN HEART ASSOCIATION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, through Resolution No. R-2001-46 the City of Tamarac has
received and accepted one Automatic External Defibrillator (AED) from the
American Heart Association (AHA) originally donated by the North Broward
Hospital District (NBHD) for use at the Kings Point Clubhouse; and
WHEREAS, pending execution of appropriate documents, the City agreed
to act as a conduit and transfer ownership, possession and responsibility to
Kings Point Of Tamarac, Inc. for use at the Kings Point Clubhouse; and
WHEREAS, Kings Point in Tamarac, Inc. has declined to execute the
required documents accepting the AED and releasing the City from liability; and
WHEREAS, the American Heart Association has requested that the City
return the AED to the North Broward Hospital District; and
WHEREAS, the North Broward Hospital District has agreed to accept the
AED; and
WHEREAS, the City desires to comply with the request by the AHA and
NBHD to return possession and ownership of the same AED to the NBHD; and

WHEREAS, it is the recommendation of the Fire Chief that Tamarac return
ownership of the AED to the NBHD, as requested by the AHA; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
repeal Resolution No. R-2001-46 and return the AED to the NBHD through the
AHA, thereby complying with the request of the North Broward Hospital District
and the American Heart Association.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
SECTION 2: The City of Tamarac does hereby repeal Resolution No.
2001-46 and authorizes the appropriate City Officials to return the Automatic
External Defibrillator to the North Broward Hospital District through the American
Heart Association.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
