R-2001- 9/ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ENCOURAGING THE STATE LEGISLATURE TO REPLACE THE FUNDS APPROPRIATED FROM THE FLORIDA PRESERVATION 2000 TRUST FUND TO THE SAVE OUR EVERGLADES TRUST FUND AS OUTLINED IN SENATE BILL 2002; DIRECTING THE CITY CLERK TO SEND A COPY OF THIS RESOLUTION TO THE BROWARD COUNTY LEGISLATIVE DELEGATION AND THE BROWARD COUNTY BOARD OF COUNTY COMMISSIONERS FOR CONSIDERATION DURING THE 2001 LEGISLATIVE SESSION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Everglades is a vital park of Florida's heritage and is recognized nationally and internationally as one of the world's most significant but imperiled ecosystems; and WHEREAS, the economic and environmental sustainability of South Florida and adequate water supplies for five million residents are dependent upon restoration of the Everglades; and WHEREAS, the State of Florida's economic health is dependent upon finding a balance in meeting the needs of the urban, agricultural and natural areas; and WHEREAS, pursuant to the Water Resources Development Act (WRDA), federal, state and local governments have devoted great amounts of money, time and energy to restoring the Everglades; and Ll Temp. Reso # 9342 - April 4, 2001 Page 2 WHEREAS, restoring the Everglades will improve South Florida's natural resources, enhance water supply, enrich the quality of life and maintain the economy, as well as being the key to a sustainable South Florida; and WHEREAS, restoring the Everglades will provide specific benefits to Broward County residents such as a buffer between the urban areas and the Everglades, stormwater treatment areas to clean up pollution, reservoirs to enhance future water supply demands and the restoration of Water Conservation Areas in western Broward County; and WHEREAS, over a decade ago, the State created a 10-year program entitled Preservation 2000 to guarantee a steady and protected funding source for the purchase and management of lands identified as important for environmental, recreational and drinking water resource needs; and WHEREAS, the Preservation 2000 program set aside $3 billion in tax revenues specifically for land conservation; and WHEREAS, in 1998, Florida voters voted overwhelmingly to extend the program another 10 years; and WHEREAS, the program was renamed Florida Forever and extended until the year 2010; and WHEREAS, among other things, the Florida Forever program grants monies for acquiring and managing environmentally -sensitive lands on a local level; and WHEREAS, the City of Tamarac recognizes the importance of protecting environmentally -sensitive lands; and 1 Temp. Reso # 9342 - April 4, 2001 Page 3 WHEREAS, the plan to restore the Everglades is expected to cost $8 billion over 20 years and the Water Resources Development Act mandates a 50/50 cost sharing between the State of Florida and the United States Congress; and WHEREAS, the State's share was to be funded from general revenues and cuts in the South Florida Water Management District expenditures; and WHEREAS, on April 3, 2001, the Florida Senate approved Senate Bill 2002 (attached hereto as "Exhibit A"), part of which amends Section 259.101 of the Florida Statutes, entitled "Florida Preservation 2000 Act" and appropriates up to $100 million in Fiscal Year 2001-2002 from the Florida Preservation 2000 Trust Fund to the Save Our Everglades Trust Fund; and WHEREAS, the $100 million is to be used for the acquisition of lands needed for restoration of the Florida Everglades; and WHEREAS, in transferring the funds, the Senate has freed up general revenue money that had been slated for the restoration of the Everglades so that it may be used for public school and health care programs; and WHEREAS, there has not been an identified funding source to replace the funds being appropriated out of the Florida Preservation 2000 Trust Fund; and WHEREAS, the practice of transferring funds from a protected revenue source threatens the integrity of the Florida Forever program; and WHEREAS, local preservation projects may be jeopardized unless a replacement funding source is identified and tapped into; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to encourage the Temp. Reso # 9342 - April 4, 2001 Page 4 State Legislature to replace the funds appropriated from the Florida Preservation 2000 Trust Fund to the Save Our Everglades Trust Fund as outlined in Senate Bill 2002. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2: The City Commission of the City of Tamarac encourages the State Legislature to replace the funds appropriated from the Florida Preservation 2000 Trust Fund to the Save Our Everglades Trust Fund as outlined in Senate Bill 2002. Section 3: The City Clerk is directed to send a copy of this resolution to the Broward County Legislative Delegation and the Broward County Board of County Commissioners for consideration during the 2001 Florida Legislative Session. Section 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in 11 Temp. Reso # 9342 - April 4, 2001 Page 5 1 11 application, it shall not affect the validity of the remaining portion or applications of this Resolution. Section 6: This Resolution shall become effective immediately upon its adoption. PASSED, ADOPTED AND APPROVED this 11th day of April, 2001.
