R-2001-98 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING THE NEOPOST S170 ADVANCED MAILER MACHINE LOCATED IN THE FINANCE DEPARTMENT AS SURPLUS AND AUTHORIZING THE SALE OF SAID EQUIPMENT THROUGH A SEALED BID PROCESS; PLACING ALL PROCEEDS INTO THE GENERAL FUND; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, The City of Tamarac Finance Department Customer Service Division purchased a Neopost S170 in May, 1996 for use in folding, sorting and inserting the City's utility bills for mailing purposes; and WHEREAS, in order to streamline the process and because of the technical problems associated with the machine, the decision was made to outsource the function through Postal Center International, Inc.; and WHEREAS, since Postal Center International, Inc. is currently processing the utility bills for mailing purposes, it was more efficient and economical for them to prepare the bills for mailing; and Temp. Reso #9339 March 26, 2001 Page 2 Revision #1, April 16, 2001 WHEREAS, outsourcing the folding, sorting and insertion process has proven to save the City cost in dollars and staff time; and WHEREAS, pursuant to § 2-316 of the Code of Ordinances, any property, real or personal, acquired by the City, irrespective of how acquired, may be used, maintained, sold, exchanged or leased, whenever the City Commission shall determine that is in the best interest of the City to do so; and WHEREAS, any personal property sold shall be sold only after the terms of the proposed sale have been advertised in a newspaper of general circulation within the City once a week for at least two (2) weeks; and WHEREAS, since this is specialty equipment and would not generally be used by the public, the City will be able to solicit other governmental agencies, organizations and corporations through a sealed bid process, and WHEREAS, the equipment offered for sale will be available for inspection to the public prior to the advertised bid opening; and 1 Temp. Reso #9339 March 26, 2001 Page 3 Revision #1, April 16, 2001 WHEREAS, the City of Tamarac reserves the right to establish a minimum bid or reject all bids on any or all items; and WHEREAS, the Director of Finance and Purchasing and Contracts Manager recommend that the Neopost S170 Advanced Mailer equipment be deemed as surplus and offered to sale through a sealed bid process; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac, that the Neopost S170 Advanced Mailer equipment be deemed as surplus and offered to sale through a sealed bid process. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. Reso #9339 March 26, 2001 Page 4 Revision #1, April 16, 2001 SECTION 2: The appropriate City Officials declare that the equipment consisting of the Neopost S170 Advanced Mailer be deemed surplus and sold utilizing a sealed bid process. SECTION 3: All proceeds from the bid shall be placed in the General Fund to be used for public purposes. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of the Resolution. 1 1 Temp.
