R-99 - Oak A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO RENEW THE 1997 AGREEMENT WITH PRESTIGE PROPERTY MANAGEMENT AND MAINTENANCE, INC., IN THE AMOUNT OF $255,964 FOR LANDSCAPE SERVICES FOR AN ADDITIONAL ONE- YEAR PERIOD; AUTHORIZING A REDUCTION IN THE PUBLIC WORKS DEPARTMENT PERSONNEL COMPLEMENT; AUTHORIZING A BUDGET TRANSFER; AUTHORIZING A CONTRACT ADDENDUM IN THE AMOUNT OF $50,006 FOR ADDITIONAL LANDSCAPING SERVICES; AUTHORIZING A TOTAL ANNUAL EXPENDITURE IN AN AMOUNT NOT TO EXCEED $305,970; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on December 10, 1997, the City of Tamarac and Prestige Property Management and Maintenance, Inc. entered into an Agreement, hereto attached as Exhibit 1, for grounds maintenance and landscaping services for City maintained roadways and facilities; and WHEREAS, in accordance with Section 2.4 of the Agreement both parties mutually agree to enter into a one year contract renewal, letter of intent hereto attached as Exhibit 2, in an annual amount not to exceed $255,964; and WHEREAS, the Director of Public Works recommends that the Public Works Departmental Personnel Complement be reduced by two (2) vacant full-time positions which include one Landscape Maintenance Worker I and one Landscape -Irrigation Specialist; and Temp. Reso. #8451 Page 2 December 14, 1998 WHEREAS, the cost impact associated with the elimination of these positions will result in an annual savings of $61,371; and WHEREAS, as a direct result of this savings the City is able to extend the contractual scope of work to include additional areas of service, a copy of said addendum being hereto attached as Exhibit 3, in an amount not to exceed $50,006 and WHEREAS, a budget transfer is necessary within the General Fund for proper accounting purposes; and WHEREAS, funding for the total amount of $305,970 is available within the Stormwater Management and General Funds; and WHEREAS, the Director of Public Works and Public Works Operations Manager recommend that the City renews and extends its Agreement with Prestige Property Management and Maintenance, Inc., for contract landscaping and grounds maintenance services; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac that ground maintenance services are renewed and extended with Prestige Property Maintenance and Management, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. Reso. #8451 Page 3 December 14, 1998 1 1 1 SECTION 2: That the appropriate City Officials are hereby authorized to execute a one-year renewal of the Agreement between the City of Tamarac and Prestige Property Management and Maintenance, Inc., for landscaping maintenance services, in an amount not to exceed $255,964. SECTION 3: That the appropriate City Officials are hereby authorized to execute an addendum to the Agreement between the City of Tamarac and Prestige Property Management and Maintenance, Inc., for additional landscaping maintenance services, in an amount not to exceed $50,006 (attached hereto as Exhibit 3). SECTION 4: That the Personnel Complement in the Public Works Department is hereby reduced by the following two (2) full-time positions: Landscaping - Maintenance Worker I and Landscaping -Irrigation Specialist. SECTION 5 That a budget transfer in the amount of $61,371 is hereby authorized in the General Fund from the Landscape Division's personal services accounts to contractual services. SECTION 6: That an annual expenditure in an amount not to exceed $305,970 is hereby authorized from within the Stormwater Management and General Funds. SECTION 7: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 8: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or 1.
