CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-99 /U
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, OPPOSING HOUSE
BILL 3075 INFRINGING UPON THE RIGHTS OF LOCAL
GOVERNMENTS TO REGULATE LOCAL LAW
PENSION PLANS; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, House Bill 3075, a bill which mandates pension benefits for
police officers and fire fighters was vetoed by Governor Chiles, subsequent to the
end of the last legislative session; and
WHEREAS, there has been discussion in Tallahassee relative to
scheduling a special legislative session to reconsider this bill; and
WHEREAS, Governor Chiles, in his veto letter of May 27, 1998 noted that
House Bill 3075 "contains provisions which are confusing and frequently
misleading"; and
WHEREAS, this bill increases police and fire pension benefits at a yet to
be determined cost with no new funding source; and
WHEREAS, it is the recommendation of the City Manager that House Bill
3075 be opposed because it represents an encroachment of the state into a local
issue, i.e. home rule and it is not in the interest of local governments throughout
the state.

WHEREAS, the City Commission of the City of Tamarac, Florida, is
opposed to such legislation and desires to officially record its opposition with the
State Legislature.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and is hereby made a specific
part of this Resolution.
SECTION 2: That the City Commission of the City of Tamarac,
Florida, does hereby record its opposition to the enactment of House Bill 3075
which mandates additional police and fire pension benefits costs with no
additional funding source.
SECTION 3: That the City of Tamarac respectfully suggests to the
legislature of the State of Florida that it should not infringe upon the rights, duties
and responsibilities of local government and permit state wide unions to
circumvent the collective bargaining process by going directly to the state
legislature for benefits after bargaining for such benefits in their respective cities.
SECTION 4: The City Clerk is hereby instructed to forward a copy
of this resolution to all Broward County Cities and to all members of the Broward
legislative delegation.
SECTION 5: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.

SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
SECTION 7: This Resolution shall become effective immediately
upon its passage and adoption.
