RESOLUTION NO. R-99— I/.,3
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO REFUND
TRAFFIC SIGNALIZATION IMPACT FEES PAID TO
THE CITY BY FIRST UNION (FORMERLY ATLANTIC
NATIONAL BANK OF FLORIDA) IN THE TOTAL
AMOUNT OF $4,348.00; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Resolution 83-275 adopted an agreement with First Union
(formerly Atlantic National Bank of Florida) accepting payment of traffic
signalization fees in the amount of $4,348.00; and
WHEREAS, based on Ordinance 98-6 and discussion at the City
Commission workshop of October 27, 1998 all developers are eligible for traffic
signalization fees refunds as long as they do not have an actual written
agreement to the contrary, including those without an agreement; and
WHEREAS, First Union (formerly Atlantic National Bank of Florida) has
requested the refund of their traffic signalization fees in the amount of $4.348.00,
and there is no written agreement to the contrary (see attachment Exhibit 1); and
WHEREAS, the City Manager and Director of Finance recommend the
refund of the traffic signalization fees in the amount of $4,348.00; and

WHEREAS, the City Commission of the City of Tamarac, Florida, deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
authorize the appropriate City Officials to refund the traffic signalization fees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and is hereby made a specific
part of this Resolution.
SECTION 2: The appropriate City Officials are hereby authorized
to refund traffic signalization impact fees paid to the City by First Union (formerly
Atlantic National Bank of Florida) in the total amount of $4,348.00.
SECTION 3: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

SECTION 5: This Resolution shall become effective immediately

COMMENTS:
Following is the action taken by the City Council on the subject item:
a) Water & Sewer Developers Agreement - APPROVED.
b) Site Plan - APPROVED by the adoption of Resolution #83-275 subject to all
conditions listed on Page 4 of the Development Review Status Sheet, which are:
1. Approval of Water & Sewer Agreement by Council.
2. Approval of Water Retention Agreement by Council.
3. Dedication of Traffic Impact Fee. Developer has agreed to pay $4,348 to
satisfy the City's traffic improvement requirements, it actual -dips run"
is found to be less, developer will request reimbursement of difference.
4. Approval of Landscape Plan.
5. Council to determine if Planning Commission interpretation that the mechanical
equipment enclosure, as presently designed, does not conform with City Code.
6. Provide double striping at all parking spaces.
7. Applicant has voluntarily agreed to provide heat and smoke detectors, directly
wired to a proprietary alarm system. This will not be connected to the
Burglar Alarm System.
8. It has been determined that the wall enclosing the air conditioner is an
outside wall.
Checks were submitted for the following fees:
$1,995.00 - Drainage Retention Fee
148.50 - Drainage Improvement Fee
5,212.50 = Water & Sewer Fee

c) Landscape Plan - APPROVED as amended on the plan submitted. Fees for inspection
must be paid when application is made for a building permit.

D. Additional conditions established in order to issue the development
order are set forth as follows:
1. Subject to all conditions listed on page 4 of the Develop-
ment Review Status Sheet attached hereto;
2. The proprietary alarm system for the heat and smoke
detectors IS NOT to be wired to the'Burglar Alarm System;
3. It has been determined that the wall enclosing the air-
conditioning equipment is an outside wall and is to be
finished on both sides.
SECTION 2: Should any section or provision of this dewy ..zr�__rft�*--
declared by a court of cappetent jurisdiction to be invalid, the City Council shall
detenn ne if the other portions of the order remain valid or whether the approval
shall be null and void.
