A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO REFUND
TRAFFIC SIGNALIZATION IMPACT FEES PAID TO
THE CITY BY MARKET PLACE AT TAMARAC
ASSOCIATION (FORMERLY VILLAGE MALL) IN THE
TOTAL AMOUNT OF $11,000.00; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Resolution 83-332 adopted an agreement with Market Place
at Tamarac Association (formerly Village Mall) accepting payment of traffic
signalization fees in the amount of $11,000.00; and
WHEREAS, based on Ordinance 98-6 and discussion at the City
Commission workshop of October 27, 1998, all developers are eligible for traffic
signalization fees refunds as long as they do not have an actual written
agreement to the contrary, including those without an agreement; and
WHEREAS, Market Place at Tamarac Association (formerly Village Mall)
has requested the refund of their traffic signalization fees in the amount of
$11,000,00, and there is no written agreement to the contrary (see attachment
Exhibit 1); and
WHEREAS, the City Manager and Director of Finance recommend the
refund of the traffic signalization fees in the amount of $11,000.00; and

WHEREAS, the City Commission of the City of Tamarac, Florida, deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
authorize the appropriate City Officials to refund the traffic signalization fees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and is hereby made a specific
part of this Resolution.
SECTION 2: The appropriate City Officials are hereby authorized
to refund traffic signalization impact fees paid to the City by Market Place at
Tamarac Association (formerly Village Mall) in the total amount of $11,000.00.
SECTION 3: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

SECTION 5: This Resolution shall become effective immediately
upon its passage and adoption.

WITEREAS, pursuant to the instructions of the City Council of the City Of
Tamarac, Florida, a public meeting has been advertised in acc=tWice with applicabef
law of the date, time and place of the meeting regarding the review of the applica-
tion -for a development order by the applicant for development approval; and
MER AS, the City Council has examined and investigated the application,
staff and Planning Ctxmmission reornnwsmdations, and the attached Development Review
Status Sheet dated 12/8/83 ; and
WM AS, the City Council reviewed the development order and accompanying
documents at a public meeting; and
WHM AS, the City Council has determined that the application is in cair
plianae with all elements of its Comprehensive Plan, or will be in compliance prior
to the issuance of a Certificate of Occupancy for any unit on the development that
is the subject of the application.

SBCrICN 1: That the development described on the attached development rev
status sheet dated 12/8/ 83 is granted a development order to proceed subject to
the following conditions:
A. Construction is to be in complete compliance with the plans and speo-
ifications submitted by the developer to the City of Tamarac as described in
Section II of the Development Review Status Sheet and approved engineering drawings.
B. Commencement of construction shall be no longer than one year from the
date of this approval. If the development does not commence construction within
one year, this approval is null and void unless an extension has been granted in
accordance with applicable regulations.
C. She development order is assignable, but an assigrmment does not
discharge any assignee from strict compliance with the order unless the City Council
consents to modify any of the griginal requirements.

declared by a court of competent jurisdiction to be invalid, the City Council shall

R - - - - COMMENTS:
The City Council APPROVED your request for waiver of platting requirements
by the adoption of Resolution #83-331. You are advised to coordinate the
driveway cuts with DOT and submit to the City Planner and City Engineer a
revised site plan showing the revision of the various parking spaces and
the ground sign must be 10-feet from the property line. Central smoke
detectors are to be installed and the approval is subject to appearing
before the Beautification Committee.
The City Council APPROVED the subject revised site plan by the adoption
of Resolution #83-332 subject to submittal of revised plans showing the
relocation of the dumpster where the handicapped spaces are and relocation
• of the handicapped spaces. A four -foot sidewalk will be provided from
the sidewalk to the door of the dumpster.
The City Council TABLED the Landscape Plan for the Beautification Committees
review of the corrected plans showing the committee's revisions in addition
to the following revisions:
1. That the Landscape Plan will be adjusted to meet the site plan.
2. That pink tabebuia trees will be used in place of the damaged mahogany
trees.
3. The berms must be 36" in height.
4. The dumpster must have a hedge around it.
5. You can get either an Engineering or Building permit to avoid delay.
6. There will be no beautification inspections until such time as Council
has approved the plan after the Beautification Committee's approval.
The Water and Sewer Developers Agreement was REMOVED from the Agenda as
there is currently water service provided.
The Water Retention Agreement was APPROVED.
The Ingress/Egress Easement was accepted and APPROVED by the adoption of
Resolution #83-333.
The Utility Easement for the fire hydrant was TABLED to the 12/28/83 meeting
because of revision to the description.
Checks were submitted at the meeting for the following:
