RESOLUTION NO. R-99 /a q
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO PURCHASE FOUR
SUBMERSIBLE PUMPS FROM ABS PUMPS, INC., A
SINGLE SOURCE MANUFACTURER, AT A COST NOT TO
EXCEED $22,600.00, AND APPROVE FUNDING FROM
THE APPROPRIATE UTILITY OPERATING ACCOUNT;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABLIITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Utilities staff has identified and received approval in the
FY99 budget to rehabilitate Wastewater Pump Stations 20 and 32; and
WHEREAS, these stations were constructed in the mid 1970's and are
now in deteriorated condition; and
WHEREAS, Utilities personnel will complete the in-house rehabilitation of
stations 20 and 32 at a significant cost reduction; and
WHEREAS, ABS Pumps, Inc. complies with the Utilities Department's
Standard Bid Specification as approved products for Wastewater Pump Stations;
and

WHEREAS, Section 6-151(3) of the Tamarac City Code allows for
exception to bid requirements for equipment in excess of $10,000.00 when
available from only one (1) source; and
WHEREAS, there is only one (1) source for ABS pumps in Florida, as
documented by "Exhibit A"; and
WHEREAS, it is the recommendation of the Director of Utilities and
Purchasing/Contracts Manager recommend the purchase of four submersible
pumps from ABS Pumps, Inc. at a cost not to exceed $22,600.00; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the citizens and residents of the City of Tamarac,
Florida to purchase four submersible pumps from ABS Pumps, Inc., at a cost not
to exceed $22,600.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific
part of this resolution.

SECTION 2: That the appropriate City officials are hereby
authorized to purchase four submersible pumps at a cost not to exceed
$22,600.00 from ABS Pumps, Inc.
SECTION 3: The City Commission approved funds in the FY99
budget for the rehabilitation of wastewater pumps stations 20 and 32.
SECTION 4: That the purchase of four (4) submersible pumps at
an amount not to exceed $22,600.00, from ABS Pumps, Inc., a single source
manufacturer, is hereby approved.
SECTION 5: All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

SECTION 7: This Resolution shall become effective immediately
upon its passage and adoption.

Pursuant to your request regarding source availability of ABS service in Florida, please
be advised that we are the factory direct branch office for the state of Florida. We are
located approximately 35 miles northeast of Orlando in Orange City.
. We are also the sole source in Florida for ABS equipment, parts, and service. A complete
inventory of pumps and replacement parts is maintained at our Orange City facility where
we provide full in-house factory service and field service with our fleet of three service
trucks. We also maintain a stock of rental and loaner pumps for emergency use in
addition to providing weekly pickup and delivery of pumps requiring factory service. All
service, including motor rewinds, is done in-house by factory trained personnel.
