RESOLUTION NO. R-99-
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO CONVEY TO JOSEPH ALLAN
CAPLAN SURPLUS REAL PROPERTY
ACQUIRED FOR THE CONSTRUCTION OF
HIATUS ROAD; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac, Florida, is constructing
Hiatus Road through Land Section Seven (7); and
WHEREAS, two (2) of the parcels which were obtained to construct Hiatus Road
are not required for the project; and
WHEREAS, Joseph Allan Caplan, conveyed real property and consents to dedicate
a 15 foot public utility easement along the west side of Hiatus Road through the entire
length of said property (attached hereto as Exhibit C) to the City of Tamarac to aid in the
completion of Hiatus Road; and
WHEREAS, as consideration for Joseph Allan Caplan's conveyances to the City of
Tamarac, City will convey real property more particularly described in the attached "Exhibit
A" and "Exhibit "B", to Joseph Allan Caplan; and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in

the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to convey to Joseph Allan Caplan surplus real property acquired
for the construction of Hiatus Road.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby approves the conveyance of
surplus real property acquired for the construction of Hiatus Road to Joseph Allan Caplan.
SECTION 3: That Joseph Allan Caplan consents to dedicate a 15 foot public
utility easement along the west side of Hiatus Road through the entire length of said
property to the City of Tamarac to aid in the completion of Hiatus Road..
SECTION 4: That the appropriate City Officials of the City of Tamarac,
Florida, are hereby authorized to grant such conveyance to Joseph Allan Caplan and to
execute any documents necessary to finalize the conveyance (see "Attachment 1" entitled,
"QUIT -CLAIM DEED".
SECTION 5: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,

in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 7: This Resolution shall become effective immediately upon its
passage and adoption.
