RESOLUTION NO R-99-126
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
EXERCISING THE OPTION TO LEAVE THE
BROWARD COUNTY URBAN COUNTY
COMMUNITY DEVELOPMENT BLOCK
GRANT PROGRAM AND TO APPLY FOR
DIRECT ENTITLEMENT STATUS; AND
APPROVING THE NOTIFICATION TO THE
U.S. DEPARTMENT OF HOUSING & URBAN
DEVELOPMENT OF THE CITY OF
TAMARAC'S REQUEST TO OPT -OUT OF THE
BROWARD COUNTY URBAN COUNTY
COMMUNITY DEVELOPMENT BLOCK
GRANT PROGRAM; PROVIDING FOR
CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac has been a part of the Broward County Urban
County Community Block Grant Program for a number of years; and
WHEREAS, the City of Tamarac has exceeded the population threshold of 50,000
persons which is a requirement to become eligible to apply to the U.S. Department of
Housing and Urban Development (HUD) as a direct entitlement city; and
WHEREAS, an entitlement city status allows the City of Tamarac to apply and
directly receive annual Community Development Block Grant funding for eligible projects
and initiatives; and

WHEREAS, the Director of Community Development recommends that the City opt -
out of the Broward County Urban County Community Development Block Grant Program
and apply for direct entitlement status and funding; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interests of the citizens and residents of the City of Tamarac to approve the
notification to the U. S. Department of Housing & Urban Development of the City of
Tamarac's request to opt -out of the Broward County Urban County Community
Development Block Grant Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City of Tamarac opt -out of the Broward County Urban
County Community Development Block Grant Program by written ratification to the
Director of the U.S. Department of Housing & Urban Development, Flori a'State Office and
seek to apply for direct entitlement status.
SECTION 3: That the City Commission of the City of Tamarac, Florida,
approves the notification to the U. S. Department of Housing & Urban Development of the
City of Tamarac's request to opt -out of the Broward County Urban County Community
Development Block Grant Program (attached hereto as Exhibit 1 ").

SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

Dear Mr. Cintron:
This letter is intended to serve as official notification of the City of Tamarac's intent
to "Opt -Out" of the Broward County, Florida Urban County Community Development Block
Grant Program.
Currently, the City has retained the services of a local firm to develop a
Consolidated Plan and a Community Development Block Grant (CDBG) Application. The
City anticipates submitting the Consolidated Plan to your office for review by August 15,
2000.
By this letter, the City is requesting that your office identify the HUD Representative
that will be assigned to the City of Tamarac, Florida during the development and
implementation of the proposed CDBG Program.
