R 99--L-VD A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH THE STATE OF FLORIDA, DEPARTMENT OF MANAGEMENT SERVICES FOR THE RENEWAL OF SUNCOM LONG DISTANCE AND INTERNET ACCESS SERVICES, PROVIDING FOR CONFLICTS, PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City has been utilizing the Suncom Network Services for the provision of long distance and internet access services; and WHEREAS, Suncom Network is provided by the State of Florida, Department of Management Services, Information Technology (ITP); and WHEREAS, ITP requires the City to periodically renew the agreement that the services are provided under; and WHEREAS, the proposed agreement allows for the termination of the services by either party without any penalties with 30 days written notice; and WHEREAS, Director of MIS recommends the renewal of the agreement with ITP; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of citizens and residents of the City of Tamarac to authorize the appropriate City official to execute an agreement with ITP for the provision of long distance and internet access services. Reso. #8641 06/04/99 Page 2 I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clause is hereby ratified and confirmed as being true and correct and is hereby made a specific part of this Resolution. SECTION 2: That the City authorizes the appropriate City officials to execute an agreement attached hereto as "Exhibit A" with ITP for the provision of long distance and internet access. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are declared to be severable. T Pul-dc _ (PLEASE 'TYPE) Which is a: 1. STATE AGENCY 2. POLITICAL SUBDIVISION 3. AGENT OF THE STATE; 4. NON-PROFIT CORPORATION 5. MUNICIPALITY hereinafter referred to as the Using Agency, and the State of Florida, Department of Management Services, Information Technology, hereinafter referred to as ITP. Whereas, the Using Agency has applied for services from the state telecommunications network known as SUNCOM; and Whereas, the Using Agency complies with all requirements of Chapter 282, Florida Statutes, and the rules of ITP; NOW THEREFORE, it is agreed: 1. ITP shall provide SUNCOM Services to the Using Agency according to the Services noted and detailed in Exhibit 1 to this AGREEMENT. 2. ITP shall provide the Using Agency accessibility to SUNCOM. All lines not restricted by the Using Agency shall have access to SUNCOM. 3. Charges shall be paid to ITP by the Using Agency for these services and shall be based upon the current rates established and published by Information Technology to all state agencies and local government Communications Service Authorization (CSA) representatives. These rates shall cover administrative costs as well as network utilization, and access costs. ITP shall provide the Using Agency with an invoice each month for services utilized by the Using Agency, consistent with the billing system, rates and concepts used to develop the overall SUNCOM rate structure and cost recovery methodology. 4. Nonpayment of an invoice presented to an agency within 40 consecutive calendar days constitutes sufficient reason for Information Technology to: (a) notify the applicable common carrier to terminate service to the agency in the case of a non --state agency; or (b) notify the State of Florida Comptroller to transfer funds to the Department of Management Services under the provision of Chapter 216.292(7), Florida Statutes, in the case of a state agency. If non payment is for a SUNCOM Network Service, in the case of a non --state agency, the SUNCOM Network Control Center (NCC) will be notified to block the non -state agency's access to the network. 5• The Using Agency recognizes and agrees that the billing concepts and network configuration may be subject to changes from time--to-time as a result of changes in applicable laws, regulations, traffic patterns, and other conditions which may result in modifications to existing policy 0 decisions or directives. 8/15/97 Exhibit A SUNCOM NETWORK SERVICE;; AGRF,F'MEN'Y' PAGE. A requesting user agency shall pay its share of all initial installation costs required to connect that user agency to the SUNCOM Network. ITP, as well as the Using Agency, will be required to provide a minimum of 30 days written notice to the other party prior to termination of service, except as provided in paragraph 4 hereof. 9. The resale of any SUNCOM service to a non -qualified subscriber, where qualified subscribers are set forth in Chapter 282, F.S., is expressly prohibited. The CSA should indicate the location of the service, the type circuit (analog/digital), and speed. 2) Costs of the local loops associated with the dedicated backbone service will be a pass through charge from the TELCO providing the circuit. A full Tl to the customer premise may be used where fractional T1 service is not available. All local loops will extend from the SUNCOM DACS to the customer premise. S) All equipment (host site and customer premise) are the responsibility of the requesting agency. 4) Backbone Tls are normally provisioned B8ZS, ESF. AMI in lieu of BBZS is available, as well as SF. Required configurations should be included on the requesting CSA. 5) One call trouble resolution shall be provided to SUNCOM backbone customers. Local loop problems will be referred to the appropriate TELCO, and CPE problems will be referred back to the user agency. 6) Consolidated billing shall be rendered to the SUNCOM Dedicated Data Service customers at the published rates then in effect. Tl service requires a one time install charge. There is no install charge for DSO service. 7) Special conditions for ( X ) NO. ( )YES. SEE BELOW. City Of Tamarac USI<JG AGENCY (PLEASE TYPE) Exhibit A ATTACHMENT F to RIDER III, EXHTBIT I of the SUNCOM NETWORK SERVICE AGREEMENT INTERNET SUNCOM Internet Access Service (IAS) shall be provided according to the following terms and conditions: 1) SUNCOM Internet Access Service (IAS) shall be provided to the SUNCOM customers at the .location specified on the CSA. Installation will occur within 30 days of CSA receipt. 2) Dedicated Bandwidth IAS shall include all backbone and local loop circuits, premise router and CSU/DSU equipment, and 24 X 7 network monitoring. Maintenance shall be included for all equipment provided by SUNCOM IAS and shall include either 2 or 4 hour on -site response times as ordered by the customer. Every effort shall be made by SUNCOM to schedule service interrupting activities, i.e., network maintenance, troubleshooting or upgrades, between the hours of 8:00 pm to 10:00 pm on Wednesdays. • 3) SUNCOM IAS customers shall use registered IP addresses or IP addresses specified by RFC 1597. Addresses shall be either provided by SUNCOM (or its representative) or provided by the customer. All requests for address assignments shall be subject to SUNCOM and InterNIC address assignment policies. 4) SUNCOM IRS customers shall provide suitable secure locations for all equipment provided through IAS and shall be responsible for said equipment's physical security. 5) One call trouble resolution shall be provided to IAS customer by SUNCOM or its representatives. 6) Consolidated billing shall be rendered to the SUNCOM IAS customer at the published rates then in effect. 7) Special conditions for MaraC USING AGE CY (PLEASE TYPE) ( )NO.
