RESOLUTION NO R-99-- 14�
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO ENTER INTO THE SECOND
OF THE THREE ONE-YEAR RENEWAL
OPTIONS PERIODS FOR LOT CUTTING AND
RELATED SERVICES TO GARDEN OF LOVE
NURSERY, INC; ORIGINAL CONTRACT
AWARDED BY RESOLUTION R-98-126; CASE
NO.7-MI-99; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac has a responsibility to provide a method to correct
sanitary and safety conditions on vacant land and abandoned parcels; and
WHEREAS, it is in the best interest of the City of Tamarac to seek a vendor to
provide such contractual services; and
WHEREAS, a contract was awarded to Garden of Love Nursery, Inc. by Resolution
98-126, based on the results of the Request for Bids, #98-0513; and
WHEREAS, funding is available in the General Fund for said purposes; and
WHEREAS, bids were tabulated by the Evaluation Committee, consisting of the
Purchasing/Contracts Manager, Senior Buyer, and Buyer, based on prices submitted on
the Bid Form, contained within Bid 98-05B,which defined prices for specific services to be
rendered upon request; and

WHEREAS, subsequent to the default by Jackson's Lawn Services, Inc. the City
Commission awarded a contract to Garden of Love Nursery, Inc. by Resolution R-98-126,
(attached hereto as Exhibit "B"), which was effective until September 30, 1998; and
WHEREAS, the contract between Garden of Love Nursery, Inc. and the City
provided for three (3) additional one (1) year periods of renewal; and
WHEREAS, Garden of Love Nursery, Inc. has satisfactorily performed its
contractual services for the City of Tamarac, the Code Enforcement Manager, the
Purchasing/Contracts Manager, and the Community Development Director recommend
approval of a one (1) year agreement to begin October 1, 1999 and terminate September
30, 2000; and
WHEREAS, an aggressive thirty (30) day termination clause is contained in the
agreement which will provide each party the security needed for satisfactory performance
of the agreement; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to award the contract
for lot cutting and related services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the second of the three (3) one-year renewal option
periods with Garden of Love Nursery, Inc. for lot cutting and related services is hereby
approved and that all appropriate officials are authorized to execute the contract between
the City of Tamarac and Garden of Love Nursery, Inc. (attached hereto and incorporated
herein as Exhibit "A") for the renewal period beginning October 1, 1999 and ending on
September 30, 2000.

SECTION 3: All resolutions or parts of resolution in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

AGREEMENT BETWEEN THE CITY OF TAMARAC
AND
GARDEN OF LOVE NURSERY, INC.
THIS AGREEMENT is entered into on --u tJ G 1999, between the City
of Tamarac, a municipal corporation with principal offices located at 7525 NW 881n
Avenue, Tamarac, Florida 33321 (hereinafter "City") and Garden of Love Nursery, Inc.,
a Florida corporation, with principal offices located at 3509 Nassau Drive, Miramar, FL
33023, (hereinafter "Contractor"), for Lot Cutting and related services located at various
sites throughout the City of Tamarac, Florida 33321. The parties HEREBY agree to the
following terms and conditions.
Contractor shall furnish all labor, materials, transportation, equipment, and any
other services required to provide Lot Cutting Services consistent with the terms and
conditions in the Invitation to Bid #98-05B and the Contractor's proposal, attached
hereto as Exhibit "B" and incorporated herein as if set forth in full, of an amount not to
exceed 12 000. Unit prices shall be as noted in Contractor's proposal.
The term of this agreement shall be for one (1)-year period, commencing on
October 1, 1999 and expiring on September 30,2000. The City has the right, per the
original Agreement, to extend the original agreement for three (3) one-year renewal
periods, and has the right to terminate the Agreement on September 30 of any year
provided written notice is delivered to the Contractor by September 15t of that year or by
other termination clauses contained in the Original Contract.
Any provision in this agreement that is prohibited or unenforceable in any
jurisdiction shall as to such jurisdiction, be ineffective to the extent of such prohibition or
unenforceability without invalidating the remaining provisions hereof or affecting the
validity or enforceability of such provisions in any other jurisdiction.
This Agreement shall be governed by the laws of the State of Florida as are now
and hereinafter in force. The venue for actions arising out this Agreement is fixed in
Broward County, Florida.
This Agreement and attached Exhibit ""B constitute the entire agreement
between the City and the Contractor,

IN WITNESS WHEREOF, the parties have made and executed this Agreement
on the respective dates under each signature. City of Tamarac, through its Mayor, and
Garden of Love_Nurse_ry, Inc., through its PRESIDENT, duly authorized to execute
same.
