R-99- 141 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A SPECIAL EXCEPTION TO ALLOW SEVEN (7) RENTAL TRUCKS IN A B-3 (GENERAL BUSINESS DISTRICT) ZONING CATEGORY TO FAMILY POOL & PATIO, LOCATED AT 8175 NW 88 AVENUE IN THE TAMARAC TOWN SQUARE SHOPPING CENTER; SPECIFICALLY A PORTION OF PARCEL "A" OF THE "TAMARAC TOWN SQUARE", PLAT ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 112, PAGE 1 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; CASE NO. 2-Z- 99; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code of the City of Tamarac approves the granting of a special exception to allow seven (7) rental trucks in a B-3 (General Business District) Zoning Category to Family Pool & Patio, located at 8175 NW 88 Avenue in the Tamarac Town Square Shopping Center; specifically a portion of Parcel "A" of the "Tamarac Town Square" Plat, according to the Plat thereof as recorded in Plat Book 112, Page 1 of the Public Records of Broward County, Florida; and WHEREAS, the Planning Board held a public hearing on May 19, 1999, thereon and has recommended approval of this application; and WHEREAS, the Director of Community Development recommends approval of this May 26, 1999 - Temp. Reso. #8639 2 Revision No. 1 - June 9, 1999 1 application; and WHEREAS, the City Commission of the City of Tamarac find that approving the petition for special exception would be in keeping with the public health, safety, and general welfare of the City of Tamarac; and WHEREAS, the City Commission has examined and investigated the application and staff recommendation dated June 9, 1999; and WHEREAS, the City Commission reviewed the Special Exception request and accompanying documents at a public meeting; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a certificate of occupancy for the development; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this special exception to allow seven (7) rental trucks in a B-3 (General Business District) Zoning Category to Family Pool & Patio, located at 8175 NW 88 Avenue in the Tamarac Town Square Shopping Center; specifically a portion of Parcel "A" of the "Tamarac Town Square" Plat, according to the Plat thereof as recorded in Plat Book 112, Page 1 of the Public Records of Broward County, Florida; Case No. 2-Z-99. 1 r1i May 26, 1999 - Temp. Reso. #8639 3 Revision No. 1 - June 9, 1999 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the petition for a special exception to allow seven (7) rental trucks in a B-3 (General Business District) Zoning Category to Family Pool & Patio, located at 8175 NW 88 Avenue in the Tamarac Town Square Shopping Center; specifically a portion of Parcel "A" of the "Tamarac Town Square" Plat, according to the Plat thereof as recorded in Plat Book 112, Page 1 of the Public Records of Broward County, Florida; Case No. 2-Z-99, is HEREBY APPROVED, subject to the following conditions: 1. The applicant shall be required to pay all appropriate fees associated with the special exception. 2. The special exception is transferable administratively pursuant to compliance with City Codes, submitting documentation and payment of fees. 3. The Conditions of Approval as stated under Exhibit "A" (attached hereto). SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, 11 May 26, 1999 - Temp. Reso. #8639 4 Revision No. 1 - June 9, 1999 in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. RORFRTA �J Conditions of Approval Apply for and receive approvals of all appropriate Occupational Licenses and pay all applicable fees for the operation of a truck rental business with a maximum of seven (7) trucks and three (3) trailers/hitches. The Occupational License fees will be calculated pursuant to Section 12-37 of the City Code. 2. Apply for and receive approvals for all appropriate City permits (i.e., Building) and any other applicable permits required by any other jurisdictional agency. 3. Ensure the entire site conforms to the City's Code of Ordinances (i.e., landscaping, signage, maintenance of buildings and walls, etc....) relating to this particular business. 4. Call in all inspections and receive final approvals from all applicable departments/agencies. 5. There shall be no storage of commercial vehicles visible from the abutting rights -of -way (Pine Island Road and NW 81 Street). In addition, there shall be no trucks or trailers dropped off or parked in front of the shopping center. 6. There shall be no outside storage of automobile parts or accessories. 7. There shall be no vehicle repair permitted on site relating to the vehicles used in p p g conjunction with the business. TEMP RESO #8639 EXHIBIT "A"
