Reso. # 8647, May 27, 1999 1 d CITY OF TAMARAC, FLORIDA RESOLUTION # R-99-� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO PURCHASE LABORATORY TESTING SERVICES UNTIL SEPTEMBER 30, 1999 UTILIZING THE STATE OF FLORIDA SNAPS PRICING AGREEMENT FROM PRECISION ENVIRONMENTAL LABORATORY, AUTHORIZING EXPENDITURES NOT TO EXCEED $11,500.00; WITH FUNDING FROM THE APPROPRIATE UTILITIES OPERATING ACCOUNT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac is required by the Florida Administrative Code 62-550 and the Broward County Department of Natural Resource Protection to test the untreated well water and potable drinking water; and WHEREAS, it is more cost effective for some testing to be performed by a certified outside laboratory rather than the Water Treatment Plant Laboratory; and WHEREAS, the City Commission approved funding for laboratory testing services in each year's budget under the appropriate Utilities Operational Account; and 1 Temp. Reso. # 8647, May 27, 1999 2 WHEREAS, Harbor Branch Environmental Laboratory, has terminated their contract with the Broward County Governmental Purchasing Cooperative Group effective May 8, 1999 as attached hereto as Exhibit "1 "; and WHEREAS, the State of Florida currently has a SNAPS Pricing Agreement with Precision Environmental Laboratory for providing laboratory testing services as attached hereto in Exhibit "2"; and WHEREAS, City Code Section 6-155 allows the Purchasing and Contracts Manager the authority to utilize contracts with other governmental agencies when the best interest of the City would be served; and WHEREAS, the Director of Utilities and the Purchasing/Contracts Manager recommend the purchase of laboratory testing services from Precision Environmental Laboratory at an amount not to exceed $11,500.00; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the purchase of laboratory testing services from Precision Environmental Laboratory. Reso. # 8647, May 27, 1999 3 �J 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Resolution. SECTION 2: That purchase of laboratory testing services by the Purchasing/Contracts Manager at an amount not to exceed $11,500.00 as authorized under Section 6-155 of the City of Tamarac Code from Precision Environmental Laboratory be approved utilizing the State of Florida SNAPS Pricing Agreement. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
