CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-99- 17 o-L
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE OFFICIALS TO REFUND A
WARRANTY BOND PAID TO THE CITY BY
RAMSHIRE/FAIRWAYS OF TAMARAC IN THE
AMOUNT OF $7,132.25; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the city of Tamarac requires the person, developer, owner contractor
or subcontractor who applies for a building permit to furnish to the City a good and
sufficient bond; and
WHEREAS, the contractor, subcontractor or other person having obtained a
permit is responsible for the project until such work is approved by the City through its
designated agent, City Engineer and City Building Official; and
WHEREAS, Ramshire/Fairways of Tamarac was the developer of a project
located at the Northwest 615t Street which required a warranty bond for drainage
deficiencies; and
WHEREAS, Ramshire/Fairways of Tamarac has completed this project and
corrected the deficiencies and the City through its designated agent, City Engineer and
City Building Official have no record of outstanding issues for this project which would
prohibit the release of said warranty bond; and

WHEREAS, Ramshire/Fairways of Tamarac has requested the refund of their
warranty bond; and
WHEREAS, the warranty bond is in the form of cash; and
WHEREAS, the City Manager and Director of Finance recommend the refund of
this warranty bond; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be
in the best interest of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to refund the warranty bond payments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
SECTION 2: The appropriate City Officials are hereby authorized to
refund the following warranty bond payment paid to the City by Ramshire/Fairways of
Tamarac in the amount of $7,132.25 after the City receives the signed and notarized
Indemnification, Hold Harmless and Release Form for the project listed below.
A. File: Ramshire/Fairways of Tamarac, Bond Date: December 27, 1976,
Bond Amount: $7,132.25.
B. Accepted by Resolution 76-189 (attached hereto as Exhibit A).

SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or
applications of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE RELEASE OF
SUBDIVISION IMPROVEMENT WARRANTIES GIVEN
BY RAMSHIRE, INCORPORATED.
WHEREAS, RAMSHIRE, INC. has posted with the City a Subdivision.
Improvement Surety Bond in the amount of $22,907.50, as principal
and surety, and as an additional warranty has remitted a Savings
Bond of like value, covering the same improvements, and
WHEREAS, RAMSHIRE, INC. has submitted an Affidavit and Certi-
fication as to the actual cost of said project, and
WHEREAS, the City Engineer has inspected the project and has
recommended release of said bonds and formal acceptance of such im-
provements by the City, upon receipt of a Substitute Warranty in the
amount of $7,132.25, representing 25% of the total actual costs, as
set forth in the Affidavit and Certification.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION ONE. That the Subdivision Improvement Bonds from
RAMSHIRE, INC., in the amount of $22,907.50 each are hereby re-
leased, subject to receipt by the City of a substitute cash bond in
the amount of $7,132.25, which will also cover any existing drainage deficiency on
61st Street.
SECTION TWO: That the substitute warranty will
be held by the City for a period of one year, commencing 12/22/76.
