Reso. #8640 June 29, 1999 1 CITY OF TAMARAC, FLORIDA RESOLUTION NO. /l l -1,? 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, REQUESTING THAT THE FLORIDA BUILDING COMMISSION ADOPT A FLORIDA BUILDING CODE THAT WILL MAINTAIN THE CURRENT LEVEL OF SAFETY PROVIDED TO CITIZENS AND RESIDENTS OF BROWARD COUNTY FLORIDA IN THE CURRENT SOUTH FLORIDA BUILDING CODE; AUTHORIZING AND DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE GOVERNOR OF THE STATE OF FLORIDA, THE FLORIDA BUILDING COMMISSION, THE BROWARD COUNTY LEGISLATIVE DELEGATION, THE FLORIDA LEAGUE OF CITIES, THE BROWARD COUNTY LEAGUE OF CITIES, THE CITY COMMISSION OF EACH CITY IN BROWARD COUNTY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to §553.73, Florida Statutes, the Florida Building Commission is required to submit to the State of Florida Legislature a statewide uniform Florida Building Code prior to the 2000 regular legislative session; and WHEREAS, the Florida Building Code is in the process of drafting, reviewing and revising the Florida Building Code; and WHEREAS, Broward County is the second largest County in the State of Florida and due to its geographical location, is likely to be subject to tropical hurricanes; and WHEREAS, the proposed draft of the Florida Building Code will not ensure adequate protection by the structural components and envelop system of the building, administrative requirements and enforcement provisions, detailed plan review, and comprehensive inspection processes; and Temp. Reso. #8640 June 29, 1999 2 WHEREAS, the Building Official recommends that the Florida Building Commission adopt and authorize the use of pertinent sections of the South Florida Building Code in hurricane prone areas such as Broward County. WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to adopt uniform Florida Building Code that addressees statewide and local concerns. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and are HEREBY made a specific part of this Resolution. SECTION 2: That City Commission of the City of Tamarac, Florida, hereby petitions the Governor of the State of Florida, the State of Florida Legislature and the Florida Building Commission to adopt and authorize the use of pertinent sections of the South Florida Building Code in hurricane prone areas such as Broward County, Florida. SECTION 3: The City Commission hereby petitions the Governor of the State of Florida, the State of Florida Legislature and the Florida Building Commission to adopt provisions which will ensure that South Florida and Broward County maintains their current level of enforcement and superior hurricane provisions to adequately protect the property of citizens and avoid the escalation of insurance rates in Broward County. SECTION 4: That the City Clerk is hereby authorized and directed to transmit a copy of this resolution to the Governor of the State of Florida, the Florida Building Commission, Broward County Legislative Delegation, the Florida League of Cities, the Broward County League of Cities, and the City Commission of each City in Broward County. Reso. #8640 June 29, 1999 3 SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
