A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
APPROVING A SPECIAL EXCEPTION TO
ALLOW UP TO THREE (3) RENTAL TRUCKS IN
A B-3 (GENERAL BUSINESS DISTRICT)
ZONING CATEGORY TO TAMARAC PACK &
SHIP, LOCATED AT 10018 WEST MC NAB ROAD
IN THE TAMARAC MARKETPLACE SHOPPING
CENTER; SPECIFICALLY TRACT "A" OF THE
"TAMARAC MARKET PLACE" PLAT,
ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 118, PAGE 20 OF
THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA; CASE NO. 4-Z-99;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Code of the City of Tamarac requires the granting of a special
exception to allow up to three (3) rental trucks in a B-3 (General Business District) Zoning
Category to Tamarac Pack & Ship, located at 10018 West McNab Road in the Tamarac
Marketplace Shopping Center; specifically Tract "A" of the "Tamarac Market Place" Plat,
according to the Plat thereof as recorded in Plat Book 118, Page 20 of the Public Records
of Broward County, Florida; and
WHEREAS, the Planning Board held a public hearing on June 16, 1999, thereon
and has recommended approval of this application; and
WHEREAS, the Director of Community Development recommends approval of this

application; and
WHEREAS, the City Commission of the City of Tamarac finds that approving the
petition for special exception would be in keeping with the public health, safety, and
general welfare of the City of Tamarac; and
WHEREAS, the City Commission has examined and investigated the application
and staff recommendation dated July 14, 1999; and
WHEREAS, the City Commission reviewed the Special Exception request and
accompanying documents at a public meeting; and
WHEREAS, the City Commission has determined that the application is in
compliance with all elements of the Comprehensive Plan, or will be in compliance prior to
the issuance of a certificate of occupancy for the development; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to approve this
special exception to allow up to three (3) rental trucks in a B-3 (General Business District)
Zoning Category to Tamarac Pack & Ship, located at 10018 West 88 McNab Road in the
Tamarac Marketplace Shopping Center; specifically Tract "A" of the "Tamarac Market
Place" Plat, according to the Plat thereof as recorded in Plat Book 118, Page 20 of the
Public Records of Broward County, Florida; Case No. 4-Z-99.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:

SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the petition for a special exception to allow up to three (3)
rental trucks in a B-3 (General Business District) Zoning Category to Tamarac Pack & Ship,
located at 10018 West McNab Road in the Tamarac Marketplace Shopping Center;
specifically a portion Tract "A° of the "Tamarac Market Place" Plat, according to the Plat
thereof as recorded in Plat Book 118, Page 20 of the Public Records of Broward County,
Florida; Case No. 4-Z-99, is HEREBY APPROVED, subject to the following conditions:
1. The applicant shall be required to pay all appropriate fees associated with the
special exception.
2. The special exception is transferable administratively pursuant to compliance
with City Codes, submitting documentation and payment of fees.
3. The Conditions of Approval as stated under Exhibit "A" (attached hereto).
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.

Apply for and receive approvals of all appropriate Occupational Licenses and pay all applicab
fees for the operation of a truck rental business with a maximum of three (3) trucks and zero
trailers/hitches. The Occupational License fees will be calculated pursuant to Section 12-37
the City Code.
2. Apply for and receive approvals for all appropriate City permits (i.e.. Building) and any oth(
applicable permits required by any other jurisdictional agency.
3. Ensure the entire site conforms to the City's Code of Ordinances (i.e.. landscaping, signagi
maintenance of buidings and walls. etc....) relating to this particular business.
4. Call in all inspections and receive final approvals from all applicable de,pariments/agencies.
5. There shall be no storage of commercial vehicles visible from the abutting rights -of -way (Nob H
Road and McNab Road). In addition, there shall be no trucks or trailers dropped off or parked:
front of the shopping center.
6. There shall be no outside storage of automobile parts or accessories.
7. There shall be no vehicle repair permitted on site relating to the vehicles used in conjunction wit
the business.
