Xqq w a ag A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO APPROVE THE PROPOSED CITY OF TAMARAC 2000 STATE LEGISLATIVE AGENDA; DIRECTING APPROPRIATE CITY OFFICIALS TO SEND A COPY OF THE CITY OF TAMARAC STATE LEGISLATIVE AGENDA TO THE BROWARD COUNTY LEGISLATIVE DELEGATION AND THE FLORIDA LEAGUE OF CITIES FOR CONSIDERATION DURING THE 2000 FLORIDA LEGISLATIVE SESSION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, there is a need for the City of Tamarac to develop and submit a legislative agenda, which reflects the local issues and concerns, to the Broward County Legislative Delegation for consideration for the 2000 Florida Legislative Session; and WHEREAS, a seven -member City Legislative Agenda Committee developed the proposed City of Tamarac Agenda for the 2000 Florida Legislative Session; and WHEREAS, the Assistant to the City Manager recommends approval of the City of Tamarac 2000 Legislative Agenda, as proposed by the Legislative Agenda Committee; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to advocate for municipal interests and actively participate in the state legislative process. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City of Tamarac 2000 State Legislative Agenda (attached as Exhibit A), for the upcoming Florida Legislative Session, is hereby approved. 1 1 Temp. Reso. #8718 — Revision #2 Page 2 SECTION 3: That appropriate City officials are directed to send a copy of the City of Tamarac 2000 State Legislative Agenda to the Broward County Legislative Delegation and the Florida League of Cities for consideration during the 2000 Florida Legislative Session. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. ( No Text City of Tamarac, Florida Proposed 2000 State Legislative Action Agenda The 2000 State Legislative Action Agenda of the City of Tamarac lists important legislative and appropriation items of concern to the City. The City asks the Florida Legislature for support and consideration on these important issues. The City is willing to provide additional information on any of the legislative and appropriation items as necessary. State Legislative Items: 1. Community Development Agency Regulations — The City of Tamarac opposes any changes to the Community Redevelopment Agency regulations that would limit local governments' authority or funding to the Agency. The City understands that legislation may be considered during the 2000 Legislative Session that would change the Community Redevelopment Agency designation criteria. The City is currently evaluating the establishment of a Community Redevelopment Agency to enhance certain areas which need of physical improvement. Based on preliminary information, the targeted Community Development Area meets the current_ criteria for a CRA designation as defined by Florida Statute 163. The City opposes the creation of more stringent CRA criteria that may prevent the City of Tamarac from designating a Community Redevelopment Area. (Community Development) 2. State Solid Waste Management Trust Fund — The City of Tamarac supports the . State Solid Waste Management Trust Fund. While funding to Recycling Grant Programs may not be reestablished to historic levels, the City recognizes the need to pursue and develop alternative recycling avenues so the recycling goals can be fully accomplished. The City of Tamarac uses funding from this fund to support its Recycling Public Education Program. This program is necessary to continue efforts to improve recycling of certain solid waste material and to meet or exceed the Florida State Statute on solid waste management. The City of Tamarac also acknowledges that promoting new uses and supporting innovative programs for recycling material are important to the overall viability of the state recycling program. (Public Works) 3. Unfunded Mandates — The City of Tamarac opposes legislation that imposes unfunded mandates on cities and has not been studied for local impact. These mandates deplete limited resources from necessary City programs and services. The State of Florida Legislature recognizes how federal mandates hinder the State's ability to respond to problems and issues. Likewise, the State should not impose unfunded mandates on local governments without providing the necessary funding to operate and/or implement such mandates. (Finance) A. Police and Fire Pension — In the 1999 Legislative Session, legislation was passed (CS/HB 261) that mandated increasing police and fire pension benefits above statutory minimums. These benefit levels have been • traditionally established through collective bargaining. Police and Fire/Rescue Services comprise one of the largest expenditures in the City's Page 1 of 4 General Operating Budget. The new pension benefit levels pose a fiscal impact for the City in providing public safety services. The City supports the Florida League of Cities position on drafting legislation that provides for cities to be given a credit for police and fire pension benefits provided above the statutory minimums. The proposed legislation would minimize the fiscal impact to cities resulting from the passage of last year's legislation increasing police and fire pension benefits. 4. Home Rule Authority — The City of Tamarac supports legislation that preserves local home rule authority. Local governments should be empowered to decide their local affairs and operate their government. Home rule is crucial to continue the ability of Tamarac residents to solve local problems in ways most appropriate to their needs and conditions. (General Government) A. Solid Waste Management Services — During the 1999 Legislative Session, legislation (i.e SB 1370 and HB 2033) regarding solid waste services was filed but died in committee. If passed, this legislation would have imposed restrictions on cities in providing solid waste services and prohibited local governments from using public funds to subsidize solid waste services. The City understands that this legislation might be address in the 2000 Legislative Session. To this end, the City opposes legislation that infringes on its authority in the provision of solid waste services. The City wants to maintain maximum authority and flexibility in providing municipal services in an efficient and effective manner. B. Unified Telecommunications Tax — The City of Tamarac opposes legislation that would impair its authority to collect franchise fees from telecommunication and communications service providers that use the public rights -of -way. As proposed, the Unified Telecommunication Tax would replace state and local taxes and local franchise fees related to telecommunication and communication services with a single unified tax and fees administered at the state level. Implementation of the Unified Telecommunications Tax could negatively affect the City's revenue streams and limit the City's ability to manage the use of its public rights -of -way. The City supports a Unified Telecommunications Tax only if the legislation contains adequate protections that municipal governments will continue to receive a growing, reliable and bondable source of revenue from telecommunication and communication service providers. 5. State Revenue Sharing Program — The City of Tamarac significantly depends upon state revenue sharing resources, such as city -county revenue sharing, local ad valorem tax, cigarette tax, highway aid funds etc. The City opposes reductions in funding levels to provide essential municipal programs and services. (Finance) A. Cigarette Tax — By State Law certain revenues are earmarked to counties and municipalities for Revenue Sharing. Our research indicates that two- thirds (64%) of revenue sharing funds for municipalities is derived from the 32.4% dedication of the Cigarette Tax collections. The Cigarette Tax has produced declining revenues for the past years. This trend is likely to Page 2 of 4 accelerate with the recent tobacco lawsuit settlement. This lack of growth puts a greater strain on municipal resources. The City supports the enactment of legislation substituting an expanding revenue source for the Cigarette Tax used to fund Municipal Revenue Sharing. Legislation of this kind should also provide a minimum guaranteed level of funding from this source. B. Partial Year Assessments — Property taxes assessed on real property are a primary source of revenue for Florida municipalities. These property taxes serve as a basic funding source for public education and public safety (i.e. fire and rescue services, law enforcement and corrections). Currently, new construction that is issued a certificate of occupancy during the year is not placed on the tax roll until the following year although basic governmental services are provided. Partial assessments would provide a closer link between the benefits residents receive from municipalities and the taxes needed to support the provision of those services. The City supports the enactment of legislation implementing a partial year assessment program for real property. This legislation will allow changes in real property value to be linked to the benefits provided by local governments. 6. Statewide Building Code - The City of Tamarac supports the adoption of a statewide building code that allows the South Florida area to maintain its current level of building standards. The current South Florida Building Code contains important provisions (i.e. roofing, construction, hurricane shutters and inspection • standards) that adequately protect the property of citizens in hurricane prone areas such as Broward County. (Building & Trades) State Appropriation Items: 1. Quick Closing Fund — The City of Tamarac supports increased funding for the Governor's discretionary fund to attract Economic Development Projects to the State of Florida. Monies from the discretionary fund are used in attracting businesses and industries to Florida from other states. The City supports increased funding and financial incentives for programs tailored toward attracting new business and industry to Florida. The City also urges your support of state legislation that is favorable to developing and maintaining a positive business environment for successful economic development opportunities in the City of Tamarac. (Community Development) 2. Parks and Recreation Grant Funding - The City of Tamarac supports increased funding for the Florida Recreation Development Assistance Program (FRDAP). The 1999 appropriation level was $12 million dollars. Last year, the Governor vetoed over $2.5 million dollars in park development projects in Broward County, The City's Caporella Bridge Project totaling $62,000 was funded in the 1999/2000 State Appropriations Budget but was vetoed. This funding was necessary to replace an unsafe walking bridge at a 10-acre park in Tamarac. Page 3 of 4 E • The City of Tamarac is planning to submit another FRDAP grant application for Phase II of Caporella Park improvements. As proposed, the application will request grant funding for $102,500 with a city match of $102,500. The total project cost of $205,000. The grant will fund the construction of restrooms, bridge replacement and a parking area at Caporella Park. The City urges your support of this grant application. (Parks and Recreation) 3. Florida Communities Trust Program - The City of Tamarac requests the continued funding of the Florida Communities Trust Program for parkland acquisition purposes. The City of Tamarac has limited space for park development. The City is exploring the feasibility of seeking grant funding through the Florida Communities Trust Program to acquire additional parkland. The City of Tamarac plans to submit an application to the Florida Communities Trust Program in the future and urges your support. (Parks and Recreation) Page 4 of 4
