R-99-a,5'1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE OFFICIALS TO REFUND VARIOUS PERFORMANCE BONDS PAID TO THE CITY BY BONAIRE ASSOCIATES, LTD. IN AN AMOUNT TOTALING $6,234.86; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac requires the person, developer, owner contractor or subcontractor who applies for a building permit to furnish to the City a good and sufficient bond; and WHEREAS, the contractor, subcontractor or other person having obtained a permit is responsible for the project until such work is approved by the City through its designated agent, City Engineer, City Building Official and Director of Utilities; and WHEREAS, Bonaire Associates, Ltd. was the developer for various projects which required performance bonds for: A. $624.00 for landscaping canal slope at 7800 NW 78 Street B. $1,000.00 for landscaping and sidewalk repairs at 7730 NW 79 Street C. $576.00 for landscaping at 7800 NW 78 Street D. $1,059.75 for a Beautification Bond covering landscaping at Building 5, Site Plan #6 Temp. Reso. #8762 September 10, 1999 Page 2 E. $258.71 for Water and Sewer Development Agreement for 42 ERC's at Woodmont Tracts 74/75 , SE corner of NW 78 Street and 80 Avenue F. $2,000.00 for demolition and removal of a 60 by 25 foot Conventional Office trailer at Woodmont Tracts 74/75 G. $716.40 for landscaping at Woodmont Tracts 74/75, Site Plan 1, Phase II; and WHEREAS, Bonaire Associates, Ltd. has completed these projects and corrected all deficiencies and the City through its designated agent, City Engineer, Director of Utilities and Building Official has no record of outstanding issues for these projects which would prohibit the release of said performance bonds; and WHEREAS, Bonaire Associates, Ltd. has requested the refund of these performance bonds; and WHEREAS, the performance bonds are in the form of cash; and WHEREAS, the City Manager and Assistant City Manager/Interim Director of Finance recommend the refund of these performance bonds; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to refund the performance bond payments. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Reso. #8762 September 10, 1999 Page 3 SECTION 2: The appropriate City Officials are hereby authorized to refund the following performance bond payments paid to the City by Bonaire Associates, Ltd. in an amount totaling $6,234.86 after the City receives the signed and notarized Indemnification, Hold Harmless and Release Form for the projects listed below. A. $624.00 for landscaping canal slope at 7800 NW 78 Street B. $1,000.00 for landscaping and sidewalk repairs at 7730 NW 79 Street C. $576.00 for landscaping at 7800 NW 78 Street D. $1,059.75 for a Beautification Bond covering landscaping at Building 5, Site Plan #6 E. $258.71 for Water and Sewer Development Agreement for 42 ERC's at Woodmont Tracts 74/75 , SE corner of NW 78 Street and 80 Avenue F. $2,000.00 for demolition and removal of a 60 by 25 foot Conventional Office trailer at Woodmont Tracts 74/75 G. $716.40 for landscaping at Woodmont Tracts 74/75, Site Plan 1, Phase II; SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 u 1 SECTION 5: passage and adoption.
