R-99- o� r A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING THE ANNUAL BUDGET OF ESTIMATED REVENUES AND EXPENDITURES FOR THE FISCAL YEAR 1999 SENIOR AND COMMUNITY CENTER BUDGET; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission on the 6th day of July 1998, adopted Resolution No. R-98-207 approving a referendum question for the acquisition and construction of a Senior and Community Center to be financed by the issuance of general obligation bonds; and WHEREAS, the referendum question was approved by a majority vote of qualified electors on the 15' day of September, 1998; and WHEREAS, the City has issued general obligation debt in an amount of $3,250,000 for the purpose of financing the construction; and WHEREAS, the acceptance of these funds requires the amending of estimated revenues and expenditures funds within the General Fund and General Construction Funds budget; and WHEREAS, it is also necessary to provide a budgetary mechanism to address the requirements for furniture, fixtures, and equipment that is part of the construction contract; and WHEREAS, the City Manager has recommended these amendments to the present annual budget to properly account for all budgetary actions related to the January 18, 1999 - TEMP. RESO. #8518 - 2 construction of the Senior and Community Center; and WHEREAS, the City Manager's recommendations address issues deemed to be in the best interest of the City of Tamarac; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend the FY 99 Budget to address the actions needed to implement the construction of the Senior and Community Center. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The budget of the City of Tamarac is hereby amended, in accordance with the Senior and Community Center Budget Document (attached as Exhibit A) and all necessary Budgetary transfers of funds are hereby approved. Section 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Issue: FY 99 Senior and Community Center Budget. Background: The FY 99 Adopted Budget included an appropriation of $100,000, to be funded with Bond Proceeds, for the beginning of the design and construction of the Senior and Community Center. Temporary Resolution 8518 amends the current budget to implement the remaining actions necessary for the design and construction of the facility. The actions include budgeting the remaining $3,150,000 in bond proceeds; $80,000 in interest that is anticipated to be earned from the proceeds; and recognizing $75,000 in additional Local Option Gas Tax and State Revenue Sharing proceeds. To complete the FY 99 design and construction budget, there will a reallocation of appropriations from the Police Services Contract ($150,000), Commission Contingency ($100,000) and the Road Resurfacing Program Capital Improvement Project ($95,000). These actions will leave a remaining balance of $226,068 in furniture and equipment to be funded in the FY 00 Budget. Marg et �cGarrity 0
