R-99- a k1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE A DEFERRED LOAN PROGRAM AND NOT IMPLEMENT CIAC IMPACT FEES FOR THE AFFECTED SEVENTY-FIVE PROPERTY OWNERS OF THE TAMARAC LAKES SECTION 1 WASTEWATER SERVICE EXTENSION PROJECT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, there is a residential section of approximately seventy-five homes in the Tamarac Lakes section of the City of Tamarac that utilizes individual septic systems for the treatment and disposal of wastewater; and WHEREAS, it has been shown that the use of a wastewater collection system and a wastewater treatment facility provides more effective treatment and disposal of wastewater and provides a much lower health risk than the use of septic systems; and WHEREAS, the City of Tamarac submitted an application to Broward County, the Urban County administering the United States Department of Housing and Urban Development for the 2511 Year Funding, for Community Development Block Grant (CDBG) funds; and 1 Temp. Reso. #8789, October 11, 1999 2 Revision 1 October 21, 1999 WHEREAS, the City's grant application was approved in the amount of $210,000 for the extension of wastewater service to Tamarac Lakes Section 1, a neighborhood in a census tract of predominantly low to moderate income residents; and WHEREAS, at the workshop meeting of June 21, 1999, the Utilities Department staff presented recommendations to the City Commission which recognized the CDBG grant funding and which minimized the costs to affected property owners within the proposed Wastewater Service Extension Project; and 1 WHEREAS, the recommendation included the establishment of a five-year "deferred loan " program for the payment of the charges for individual property connections to the wastewater system and proper destruction or removal of the existing septic tanks; and WHEREAS, as part of the deferred loan program, the City pays the cost of the wastewater connection and septic tank destruction or removal, places a lien on the property, and requires recipients to maintain ownership of the property for five years to realize full forgiveness of the lien; and 1 Temp. Reso. #8789, October 11, 1999 3 Revision 1 October 21, 1999 WHEREAS, since the Tamarac Lakes Section 1 properties are in an area of Tamarac formerly known as Tamarac Utilities East, an area that is provided water and wastewater service by Ft. Lauderdale, and since the area is essentially built -out, the addition of seventy-five properties to the wastewater system will not require the construction of growth -related capital projects by Tamarac or require an increase in sewer capacity within the utility system, and it is therefore not appropriate to charge a Contribution In Aid of Construction (CIAC) fee, which is a growth -related impact fee, to the seventy-five Tamarac Lakes Section 1 property owners affected by the project; and WHEREAS, the City Commission expressed support at the June 21, 1999 Workshop meeting for implementing the deferred loan program and not implementing CIAC charges for the affected property owners of Tamarac Lakes Section 1; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac that they authorize the appropriate City Officials to offer financial assistance to the seventy-five Tamarac Lakes Section 1 property owners by establishing a deferred loan program and waive the CIAC impact fees associated with connection to the Tamarac municipal wastewater system. 1 D I 1 Temp. Reso. #8789, October 11, 1999 4 Revision 1 October 21, 1999 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: The appropriate City Officials are hereby authorized to implement a deferred loan program on a five-year basis to assist Tamarac Lakes Section 1 property owners with the cost of individual wastewater service line connections. SECTION 3: The appropriate City Officials are hereby authorized to not implement the CIAC fees associated with connection of the seventy-five properties in Tamarac Lakes Section 1 to the Tamarac municipal wastewater system. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or Temp. Reso. #8789, October 11, 1999 5 Revision 1 October 21, 1999 invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Grantee's right to utilize the easement area shall be exclusive to the extent that Grantor shall grant no easement or license, nor make any covenants, having the effect of permitting use of the easement area by one other than Grantee, except grantor may furnish an easement to Florida Power and Light, Bell South, Sunrise Gas or franchised cable TV that crosses this easement at right angles. 980605 1 Wastewater PS 22 - W S Utility Easement C7 Grantor may, for its own purposes, utilize the easement area and shall retain a right of free ingress and egress under, over and upon the easement area; provided that, in no event, shall any of the rights herein reserved to Grantor impede the easement herein granted or the exercise of the rights of use thereunder. Grantee shall have the right to remove any natural or man made obstructions placed on the easement which impede the easement herein granted or the exercise of the rights thereunder. Grantor grants to the Grantee, a perpetual non-exclusive easement upon the servient estate whereby Grantee shall have reasonable access necessary to fully exercise Grantee's rights within the easement area. The provisions of the easement shall be binding on the parties hereto and their respective successors and assigns as a covenant running with and binding upon the servient estate. This easement shall not be released or amended without consent of the Grantee as evidenced by a document signed with the same formalities as this document. Grantee shall record this document in the Public Records of Broward County, Florida. This instrument contains the.entire agreement between the parties relating to the rights granted and the obligations assumed pursuant to this instrument.
