R-99-_a A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO AUTHORIZE THE APPROPRIATE CITY OFFICIALS TO CORRECT AND CHANGE THE ADDRESS ADOPTED BY RESOLUTION NO. R-99-216 FOR THE PROSPECT COMMERCIAL, INC., COMMERCIAL SHOPPES PROJECT UTILITY EASEMENT ENCROACHMENT AND HOLD HARMLESS AGREEMENT TO 2400 WEST COMMERCIAL BOULEVARD FOR THE LANDSCAPING ERECTED IN THE UTILITY EASEMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Resolution No. R-99-216 was adopted on September 8, 1999 authorizing City Officials to accept and execute a "Utility Easement Encroachment and Hold Harmless Agreement" with Prospect Commercial, Inc., for the landscaping erected in a utility easement at the Commercial Shoppes Project at 4800 West Commercial Boulevard; and WHEREAS, the legal description for the utility easement attached to the Utility Easement Encroachment and Hold Harmless Agreement was correct, but a scrivener's error in Resolution No. R-99-216 incorrectly referenced the street address as 4800 West Commercial Boulevard as the address for the Commercial Shoppes Projects; and Temp. Reso. #8805, September 19, 1999 2 Rev. #1 November 2, 1999 WHEREAS, the correct address for the Commercial Shoppes Project (attached hereto in map form as "Exhibit 1 ") is 2400 West Commercial Boulevard; and WHEREAS, it is incumbent upon the City to maintain accurate records; and WHEREAS, the Director of Utilities recommends the acceptance and execution of this Resolution to correct and change the address for the Commercial Shoppes Project to 2400 West Commercial Boulevard in R-99-216; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept and execute this Resolution correcting and changing the address for the Utility Easement Encroachment and Hold Harmless Agreement with Prospect Commercial, Inc., Commercial Shoppes Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the appropriate City Officials are hereby authorized to correct the address adopted by resolution No. R-99-216 for the Commercial Shoppes project to 2400 West Commercial Boulevard for the purpose of executing the Utility 1 I I 1 Temp. Reso. #8805, September 19, 1999 3 Rev. #1 November 2, 1999 Easement Encroachment and Hold Harmless Agreement with Prospect Commercial, Inc. for the landscaping erected in the utility easement. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this -40-day of 2Lak�,1999.
