R-99- -3 n A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ISSUING REVISED DEVELOPMENT ORDER NO. 182.4 AND GRANTING NEW DEVELOPMENT SITE PLAN APPROVAL TO UNIVERSITY AND MCNAB RETAIL STORES FOR THE CONSTRUCTION OF A 4,000 SQUARE FOOT RETAIL STORES BUILDING; LOCATED AT MCNAB ROAD, WEST OF UNIVERSITY DRIVE; PURSUANT TO CHAPTER 10 OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC, FLORIDA; CASE NO. 16-SP-98; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Commission of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a development order and site plan approval by the applicant for development approval ; and WHEREAS, the City Commission has examined the application, the staff and Planning Commission recommendations, and the Development Review Status Sheet dated November 4, 1998 (attached hereto as Exhibit °1"); and WHEREAS, the Development Review Committee recommended approval on October 10, 1998; and 1 November 4, 1998 - Temp. Reso. #8442 2 WHEREAS, the Planning Commission recommended approval on November 4, 1998; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission reviewed this development order and site plan approval accompanying documents at a public meeting; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to issue Revised Development Order No. 182.4 and grant New Development Site Plan approval to University and McNab Retail Stores for the construction of a 4,000 square foot retail stores building; located at McNab Road, west of University Drive; Case No. 16-SP-98. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. 1 1 November 4, 1998 Temp. Reso. #8442 3 SECTION 2: That the Revised Development Order No. 182.4 and New Development Site Plan approval to University and McNab Retail Stores for the construction of a 4,000 square foot retail stores building; located at McNab Road, west of University Drive; is HEREBY APPROVED subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall begin no later than one (1) year from the date of this approval. If the development does not commence construction within one (1) year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Commission consents to modify any of the original requirements. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. CITY OF TAMARAC 0 TO: FROM: INTEROFFICE MEMORANDUM 98-11-005M COMMUNITY DEVELOPMENT DEPARTMENT City Manager Director of Community Development DATE: November 25, 1998 RE: University and McNab Retail Stores - New Development Site Plan CASE#: 16-SP-98 MF#: 6-85 — Temp Reso #8442 RECOMMENDATION: The Director of Community Development recommends approval of this New Development Site Plan. This application was approved at the October 10, 1998 Development Review Committee meeting and the November 4, 1998 Planning Commission meeting. ISSUE: The applicant is requesting approval of a New Development Site Plan to allow the construction of a 4,000 square foot retail stores building. BACKGROUND: 1. Application Information: APPLICANT: McNab Joint Venture/Anthony Fraga, Jr. OWNER: University and McNab Retail Stores (Outparcel 3) LEGAL DESCRIPTION: A parcel of the "Fort Lauderdale Truck Farms Plat", according to the Plat thereof as recorded in Plat Book 4, Page 31 of the Public Records of Broward County, Florida. LOCATION: McNab Road, west of University Drive EXISTING ZONING: B-2 EXISTING LAND USE: Commercial 2. The applicant is requesting approval of a Site Plan for the construction of.- 4,000 square foot retail building. The building is the last outparcel to be constructed within the University and McNab Retail Center. The applicant, at this time, does not have any proposed tenants, but has designed the building to be able to accommodate up to two (2) tenants. The proposed ingress/egress to the site is consistent with the overall approved Site Plan for the Winn -Dixie Store. The ingress/egress to the site, as it exists now, is slightly different than what it ultimately will be. This is because Broward County gave approval to the developer for a temporary ingress/egress design until McNab Road is widened. Once McNab Road is completed, then the overall ingress/egress onto McNab Road will be consistent with the approved Site Plan. 0 City Manager University and McNab Retail Stores—16-SP-98 November 25, 1998 — Page 2 0 3. The proposed use is consistent with the Comprehensive Plan and Future Land Use Plan Map. 5. The applicant shall provide a digital copy of all plans, including "As Builts", produced using a Computer Aided Drafting (CAD) software to the Community Development Department prior to the issuance of a Certificate of Occupancy. Note: The City uses the latest version of AutoCAD. If the applicant desires, the City will accept Drawing Exchange Files (DXF) and Microstation Design Files (DGN). 6. Local Traffic Impact Fees in the amount of $3,472.00 (calculated pursuant to Section 10-290 of the City's Code of Ordinances) are due prior to the issuance of a Building Permit. 7. Streetscape Improvement Fees in the amount of $800.00 (calculated pursuant to Section 10- 313 of the City's Code of Ordinances) will be due prior to the issuance of a Building Permit.
