RESOLUTION NO. R-99-30 7
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
GRANTING A MODEL SALES PERMIT FOR A
SIX (6) MONTH PERIOD FOR THE MERRILL
GARDENS ASSISTED LIVING FACILITY (ALF)
LOCATED AT 7650 NORTH UNIVERSITY
DRIVE; CASE NO. 2-MS-99; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Article VI of Chapter 24 of the City Code provides for approval of
temporary use model, sales and administrative facilities; and
WHEREAS, Merrill Gardens, L.L.C. is requesting a model sales permit for the Merrill
Gardens Assisted Living Facility (ALF) located at 7650 North University Drive and have
paid their permit fees; and
WHEREAS, Merrill Gardens ALF has requested the 300-foot distance separation
between the model sales trailer and leased units be reduced to 0 feet due to the project
being developed as an assisted living facility; and
WHEREAS, Merrill Gardens ALF is requesting the distance waiver due to the
potential hardship of not being able to occupy leased units; and
WHEREAS, the Interim Director of Community Development recommends approval
of the model sales permit; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in

the best interests of the citizens and residents of the City of Tamarac to grant this model
sales permit.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby approves the model sales
permit for the Merrill Gardens ALF located at 7650 North University Drive for a six (6)
month period from November 10, 1999 to May 10, 2000.
SECTION 3: That the distance separation from three -hundred (300) feet to
zero (0) feet between the model sales trailer and leased units with certificates of occupancy
(due to the project being developed as an assisted living facility) is hereby approved.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.

SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.
